Detention of U.S. Citizens

Description: In 1971, Congress passed legislation to repeal the Emergency Detention Act of 1950 and to enact the following language: “No citizen shall be imprisoned or otherwise detained by the United States except pursuant to an Act of Congress.” The new language, codified at 18 U.S.C. §4001(a), is called the Non-Detention Act. Immigration-Related Detention: Current Legislative Issues

Description: The attacks of September 11, 2001, have increased interest in the authority under statute to detain noncitizens (aliens) in the United States. Under the law there is broad authority to detain aliens while awaiting a determination of whether the noncitizen should be removed from the United States.
