increasing potential for interference on aeronautical frequencies,
due to a number of factors, including growth in the number of
stations in the aeronautical and the broadcasting services. The
Notice of Proposed Rule Making (Notice)' suggested the establish-
ment of a set of compatibility criteria as a possible solution
equitable to both the aeronautical service and the broadcasting
service.
2. In response to the Notice, the Commission received 7
comments and 5 reply comments.2 Although the comments raised
significant concerns about the aeronautical interference issues,
they did not provide enough substantive information from which
final rules could be adopted.
3. Further, the International Radio Consultative Committee
(CCIR) (specifically, the Joint Interim Working Party (JIWP)
8-10/1 on Compatibility Between FM Broadcasting and Aeronau-
tical Services near 108 MHz) is scheduled to meet in late 1986.
We believe that, although a solution to the aeronautical interfer-
ence dilemma is necessary, final action would be premature until
after the international meeting is held. Therefore, we are terminat-
ing this proceeding at this time, but are retaining the comments
for review in the future. This action should not be viewed as a
lessening of Commission interest in this matter.
4. For these reasons, IT IS ORDERED that MM Docket No.
85-108 IS TERMINATED. This action is taken pursuant to
authority contained in Sections 4 and 303 of the Communications
Act of 1934. This action is effective upon adoption, in accordance
with Section 553(d) of the Administrative Procedure Act, in that
no rulemaking action is being taken at this time.
