made studies indicating that with minor extensions it may provide
microwave relay service for a number of other communities in Colo-
rado and Nebraska not here involved in this proceeding.
7. A. T. & T. at the time of the hearing had neither existing nor
prospective customers for its proposed service.
8. There is no agreement in effect for Collier Electric to lease to
A. T. & T. certain land, towers, buildings, and other equipment owned
by the partnership.
9. The A. T. & T. applications are conditioned upon the use of
certain facilities owned by Collier Electric at Sterling and Sidney.
However, as heretofore stated, Collier has not acquiesced in the use
of these facilities by A. T. & T. which renders performance impossible
by A. T. & T. as proposed in its applications.
10. The proposed off-the-air point-to-point microwave relay service
of either applicant will not be indirectly or directly connected with
the nationwide general telephone network of the Bell System com-
panies or other communication plant of any communications common
carrier.
11. In comparison of the rates it is evident that the proposed
Collier Electric rates are lower than those embodied in the A. T. & T.
application. Further, A. T. & T. proposed a termination charge
which could range from $86,750 to a possibility of $129,650, while on
the other hand Collier Electric applications provide for no termina-
tion charges. The monthly rates proposed in the application for
Collier Electric would be $575 monthly for each channel equipped for
color or an aggregate cost of $5,175 per month for 3 channels for all
3 of the presently proposed users. Collier Electric will file with the
Commission appropriate tariffs setting out its rates and conditions of
service.
12. On February 8, 1957, A. T. & T. filed with the Commission its
tariff FCC No. 223 making a regular public offering of off-the-air
pickup service. This tariff became effective March 15, 1957, but is
now the subject of an investigation by the Commission in its docket
No. 11956. Under that tariff schedule the charges for service by
means of the proposed system including three channels equipped to
transmit alternate monochrome and color signals between Fort Mor-
gan and Kimball with drops at Sterling and Sidney would be a total
of $5,530 per month plus any contingent termination charges. This
tariff, however, does not take into account any rental charges that
A. T. & T. would be required to pay for land, towers, buildings, and
other equipment of Collier Electric which cost of rental would be
passed on to its customers. There exists no lease agreement between
Collier Electric and A. T. & T. but one of the partners of Collier
Electric estimated, which is not disputed in the record, that the addi-
tional cost arising from a lease agreement would increase the total
monthly costs to $7,150 besides increasing the total termination
charges. Thus, it is evident that by any mathematical calculation,
the rates proposed by A. T. & T. would be higher than those contained
in Collier Electric's applications.
