merce, the Harrison County farm agent, the Jackson County farm
agent, and the Jackson County home demonstration agent. It also
appears that some of the programing will be by film. As to this
fact, WLOX points out that there is no evidence that such film will
be made by or for Radio Associates. Instead of 5 hours, WLOX
would have us find that Radio Associates could, on the basis of the
showing made, produce only 1 hour of local live discussion weekly.
That is the amount proposed for WLOX's own operation. WLOX
contends that the 12 hours weekly of local live entertainment credited
to Radio Associates by the examiner should be reduced to 9 hours
because (a) the program "TV Magazine of the South" should be
reclassified as "Talk" (originally, the program was classified as "Ed-
ucation," but at the hearing, Mr. Robinson said it should be talk.
The examiner ruled it should be entertainment), and (b) "Music
Room" should not be classified as "live" since it is described in Radio
Associates' exhibit (No. 5) as "featuring a staff personality with
recorded music."' The examiner credits WLOX with a total of 6
hours :of local live entertainment. WLOX contends the finding
should: be 71/2 hours weekly, with 7 hours by strictly "local" (non-
staff) talent. WLOX's exhibit No. 6 shows the following programs
to constitute the 7 hours: "Novachord Varieties," "Spotlight Time,"
"Western Studio Party," "Western Jamboree," "Talent Review,"
"Your Home," and "Talent in Our Town." These exceptions are
valid only to the extent that the program "Public Service Program"
does not meet the strict requirements of Commission definition for
educational programs although of educational content; and the pro-
gram "Music Room" from the record description would appear to
be recorded rather than live.
CONCLUSION
1. As was pointed out in paragraph 1, supra, page 1, the Counmis-
sion has found that each applicant is legally, technically, and finan-
cially qualified to construct, own, and operate a television broadcast
station. The final question, following both hearings, is that of de-
termining which of the two applicants is the better qualified in the
light of the comparative evidence received. The answer to this
question is determinative of which applicant would serve better the
public interest. The original initial decision (par. 2 of the conclu-
sions therein) stated that "such matters as local residence, partici-
pation of its officers and principal employees in public service and
community affairs, and integration of ownership and management
in the respective applicant organizations, are important factors in
comparative considerations entering into a composite evaluation of
all of the substantial factors and differences between applicants for
radiobroadcasting construction permits." The second initial deci-
sion correctly points out (par. 2-A) "Participation by 'principal
employees' of the applicants in public service and community affairs
is not of decisional importance in this proceeding; instead, signifi-
cant considerations in this area of composite evaluation are those
