74. The first initial decision contained the following paragraph:
46. Each of the applicants has made the necessary arrangements toward
effectuating at the appropriate time the full schedules of programs which it has
respectively fully listed in Radio Associates exhibit 5 and WLOX exhibit 6. Each
of the applicants has also made extensive and adequate contacts with film
producers and distributors from whom it expects to obtain necessary film for
its program schedules should it receive the proposed television station grant;
Radio Associates, Inc., having contacted some 14 film companies and WLOX
Broadcasting Co. having contacted at least 9 film companies.
WLOX excepts to the finding, on the ground that the "Examiner
'froze' the contact list of each applicant and refused to permit refer-
ences outside thereof." It is WLOX's contention that, since Radio As-
sociates' "contact list" does not describe the program content or
categories of programing, only film programing may be deemed to
be fully provided for. Radio Associates' "contact list" includes, inter
alia, the following typical persons or organizations: Biloxi USO,
Veterans' Service Center, The Veterans' Administration Office, Biloxi
American Legion, Biloxi VFW, Chamber of Commerce, Optimist
Club, the pastors of churches of several denominations, and county
farm agents. We are of the view that Radio Associates has demon-
strated through its preparation the availability of local program
sources, and that the necessary cooperation of local groups and or-
ganizations for the production of its proposed local live programing
can be expected. This view is fortified by the stipulation mentioned
in the next paragraph.
75. By stipulation by and between all the parties, dated April 26,
1954, and received in evidence on that date, it is provided:
If the individuals named on the list of 63 organizations mentioned * * * were
called as witnesses, they would testify that they had been contacted by the
WLOX Broadcasting Co. in connection with its proposed program schedule, had
discussed the program plans, and had given assurance of cooperation.
If there were called as witnesses the three individuals and the representa-
tives of the 18 organizations listed by Radio Associates, Inc., in its exchange
material, they would testify that they had been contacted by Radio Associates,
Inc., in connection with its proposed program schedule, had discussed the pro-
gram plans, and with the exception of the Biloxi Chamber of Commerce, had
given assurance of cooperation.
76. Prior to the commencement of taking of oral testimony and
reception of exhibits in this proceeding, Radio Associates, Inc.,
formulated and submitted a particularization described as a point of
reliance whereby it asserted that its proposed programing schedule and
plans demonstrated, as against WLOX Broadcasting Co.'s proposals,
Superiority with Respect to Local Programing." The following
itemizations were contained under the headings of "Education," "Dis-
cussion," "Agricultural," and "Entertainment-Local Live Talent,"
taken from its full program schedule, exhibit 5:
Education
Radio Associates, Inc., proposes an educational program from 9-9: 30 p. m.,
Monday-Friday, and another from 5: 30-6 p. m. on Saturday, the latter being
live. The specific programs are:
Monday-Friday, 9-9 : 30 p. m.
