"Don't Ask, Don't Tell": A Legal Analysis

Description: In recent years, several Members of Congress have expressed interest in amending "Don't Ask, Don't Tell," (DADT) a legislation that requires those of homosexual orientation in the military to keep quiet about their orientation in order to maintain "morale, good order and discipline, and unit cohesion." At least two bills that would repeal the law and replace it with a policy of nondiscrimination on the basis of sexual orientation - H.R. 1283 and S. 3065 - have been introduced in the 111th Congress. This report provides a legal analysis of the various constitutional challenges that have been brought against DADT; for a policy analysis, see CRS Report R40782, "Don't Ask, Don't Tell": Military Policy and the Law on

Variable Moderator Reactor Development Program. Quarterly Progress Report No. 2

Description: The hydrodynamics code BOCH was used to obtain the relationship between a large number of variables such as voids, flux, pin spacing, power density, and pressure for VMR lattices. Based upon these relationships, a reference core design was selected for examination, using the integrated physics and hydrodynamics analytical modeis. The analog representations of the VMR core kinetics describing the individual blocks of a model block diagram were completed. A simplified core physics analysis was completed, and design parameters were established. An analysis of these parameters using PUREE' was initiated. The first three energy groups and the thermal group were compared with experimental lattices. Portions of the developed code are being used to analyze the critical experiment design and to investigate the reference core design. The critical experiment facility design is about 60% complete. The preliminary program which has been planned includes consideration of the number, kinds, and schedule of experiments to be performed. Portions of the PUREE' physics analysis are being used to generate information for the hazards repert on the critical experiment. (For preceding period see ATL-A-100.) (J.R.D.)

Financial Regulatory Reform: Systemic Risk and the Federal Reserve

Description: The recent financial crisis contained a number of systemic risk episodes, or episodes that caused instability for large parts of the financial system. The lesson some policymakers have taken from this crisis is that a systemic risk or "macroprudential" regulator is needed to prevent similar episodes in the future. This report defines the potential duties and responsibilities of a systemic risk regulator, relating those duties to events that potentially contributed to the recent crisis. It then identifies the powers that would need to be given to a regulator to perform those duties, and compares those powers and responsibilities to the Fed's existing powers and responsibilities. It discusses advantages and disadvantages of giving those responsibilities to the Fed or the executive branch. The report also includes a brief overview of major elements of the Administration's proposal, H.R. 4173, which passed the House on December 11, 2009, and the Restoring American Financial Stability Act, which was ordered to be reported out of the Senate Banking Committee on March 22, 2010..
