NAFTA at Ten: Lessons from Recent Studies

Description: This report provides an analytical summary of the economic lessons reached in support of Congress's role in the trade policy process. On January 1, 2004, the North American Free Trade Agreement (NAFTA) completed its tenth year and most of its provisions are now implemented. NAFTA is a free trade agreement (FTA) that effectively added Mexico to the U.S.-Canada FTA completed in 1989. Its anniversary has sparked numerous evaluations, which are particularly relevant as the United States pursues free trade agreements with multiple Latin American countries. Most studies found that NAFTA's effects on the U.S. and Mexican economies to be modest at most.

The Open Skies Treaty: Issues in the Current Debate

The treaty entered into force on January 1, 2002, and now has 34 member states. Each participant must permit unarmed observation aircraft to fly over its entire territory to observe military forces and activities.

Progress in Environmental Specimen Banking

Description: In October, 1986, the 10th U.S.-German Seminar of State and Planning on Environmental Specimen Banking was held at the Virginia Institute of Marine Sciences in Gloucester Point, Virginia. At this meeting the current status of specimen banking activities in the U. S., FRG, Canada, and Japan was presented and discussed. This publication contains the proceedings of that meeting with contributions describing various activities related to banking and analysis of samples from aquatic, atmospheric, terrestrial, and human monitoring programs.

Country-of-Origin Labeling for Foods and the WTO Trade Dispute on Meat Labeling

Description: This report covers the dispute between the U.S with its neighbors Canada and Mexico, who say that the recent country-of-origin labeling (COOL) system implemented by the U.S. Department of Agriculture is unfair and does not meet its original objectives. This dispute was brought before the WTO dispute panel and found to be valid. The report ends with a discussion of options for the U.S. in regards to modifying COOL to follow WTO rulings.

Taking place less than four months after the U.S. presidential inauguration, the Summit could set the tone for hemispheric relations during the early stages of the Obama Administration. Canadian Oil Sands: Life-Cycle Assessments of Greenhouse Gas Emissions

Description: Recent congressional interest in U.S. energy policy has focused in part on ways through which the United States could secure more economical and reliable crude oil resources both domestically and internationally. Many forecasters identify petroleum refined from Canadian oil sands as one possible solution. This report discusses conclusions revealed from a survey of available literature on the matter, particularly in regards to Greenhouse Gas and Well-to-Tank emissions.

Canadian Oil Sands: Life-Cycle Assessments of Greenhouse Gas Emissions

Description: This report discusses basic methodology of life-cycle assessments and compares several publicly-available assessments of life-cycle emissions data for Canadian oil sands crudes against each other and against those of other global reference crudes. It also includes a survey of the scientific literature and the findings of the State Department's Keystone XL Project Envoronmental Impact Statement, and concludes with a discussion of tools for policymakers who are interested in using the assessments to investigate the potential impacts of U.S. energy policy choices onthe environment.

Proposed Keystone XL Pipeline: Legal Issues

Description: This report reviews those legal issues. First, it suggests that legislation related to cross-border facility permitting is unlikely to raise significant constitutional questions, despite the fact that such permits have traditionally been handled by the executive branch alone pursuant to its constitutional "foreign affairs" authority. Next, it observes generally that state oversight of pipeline siting decisions does not appear to violate existing federal law or the Constitution. Finally, the report suggests that State Department's implementation of the existing authority to issue presidential permits appears to allow for judicial review of its National Environmental Policy Act determinations.

Why Certain Trade Agreements Are Approved as Congressional-Executive Agreements Rather Than as Treaties

Description: U.S. trade agreements such as the North American Free Trade Agreement (NAFTA), World Trade Organization agreements, and bilateral free trade agreements (FTAs) have been approved by majority vote of each house rather than by two-thirds vote of the Senate - that is, they have been treated as congressional-executive agreements rather than as treaties. The congressional-executive agreement has been the vehicle for implementing Congress's long-standing policy of seeking trade benefits for the United States through reciprocal trade negotiations. This report discusses this topic in brief.
