Citizens' Health Care Working Group

Description: Congress authorized the Citizen’s Health Care Working Group as a provision of the Medicare Prescription Drug, Improvement, and Modernization Act Of 2003. This provision was sponsored by Senators Ron Wyden of Oregon and Orrin Hatch of Utah. The mission of the Working Group has been to provide a nationwide public debate about improving the American health care system so that health care “works for all Americans” and to use the results of that debate to provide recommendations for Congress and the President to consider as they work to achieve high quality, affordable health care. Working Group members were named February 28, 2005 and released various sets of recommendations.

Health Care: Constitutional Rights and Legislative Powers

Description: The health care reform debate raises many complex issues including those of coverage, accessibility, cost, accountability, and quality of health care. Underlying these policy considerations are issues regarding the status of health care as a constitutional or legal right. This report analyzes constitutional and legal issues pertaining to a right to health care, as well as the power of Congress to enact and fund health care programs. Following the recent passage of the Patient Protection and Affordable Care Act, P.L. 111-148, legal issues have been raised regarding the power of Congress to mandate that individuals purchase health insurance, and the ability of states to "nullify" or "opt out" of such a requirement. These issues are also discussed.

The Independent Payment Advisory Board

Description: This report, which provides an overview of the Payment Advisory Board, begins with a discussion of the rationale behind the creation of an independent Medicare board and briefly reviews prior proposals for similar boards and commissions. Medicare: Insolvency Projections

Description: This report focuses on the two separate trust funds that fund Medicare, the Hospital Insurance (HI) trust fund and Supplementary Medical Insurance (SMI) trust fund. Almost from its inception, the HI trust fund has faced a projected shortfall and eventual insolvency. Because of the way it is financed, the SMI trust fund cannot become insolvent; however, the Medicare Trustees continue to express concerns about the rapid growth in SMI costs.
