Public Access to Data from Federally Funded Research: Provisions in OMB Circular A-110

Description: The results of scientific studies are used in making many governmental policy decisions. While the studies are often published, the data on which they are based may not be, even for federally funded research. Before 1999, academic and nonprofit performers of such research were permitted but not required to make their data available to the public through provisions of the Freedom of Information Act (FOIA). In October 1998, a provision in P.L. 105-277 changed that, requiring that such data be made publicly available. This report provides background on the 1999 revisions to federal policy, a discussion of the impacts of those changes, and an analysis of the issues raised by them.

Cybersecurity Issues and Challenges: In Brief

Description: The information and communications technology (ICT) industry has evolved greatly over the last half century. The technology is ubiquitous and increasingly integral to almost every facet of modern society. ICT devices and components are generally interdependent, and disruption of one may affect many others. Over the past several years, experts and policy makers have expressed increasing concerns about protecting ICT systems from cyberattacks, which many experts expect to increase in frequency and severity over the next several years. This report discusses the concept of cybersecurity, the management of cybersecurity risks, and the federal government's role in managing such risks.

Federal Voluntary Voting System Guidelines: Issues

Description: This report discusses the Voluntary Voting System Guidelines (VVSG), which are a set of technical standards for voting systems that use computers to assist in recording or counting votes. Systems covered include most used in the United States—not only DREs (direct recording electronic systems) such as touchscreen voting machines, but also optical scan and punch card systems. Hand-counted paper-ballot and lever-machine systems, which do not involve computers, are not covered. However, they are used by a small and decreasing number of election jurisdictions.

DNA Evidence: Legislative Initiatives in the 106th Congress

Description: DNA evidence is a powerful forensic tool in criminal cases. Its use and capabilities have increased substantially since it was first introduced in the late 1980s. That growth has led to the emergence of the following issues that were considered by the 106th Congress in legislative initiatives: eliminating the nationwide backlog of unanalyzed DNA samples, expanding the kinds of offenders who are profiled, providing opportunities for post-conviction testing of DNA evidence, and continuing development of forensic science capabilities. This report discusses those and related issues and the legislation proposed and enacted to address them. It begins by describing provisions in prior federal law and then discusses issues and the legislation proposed, including the enacted DNA Analysis Backlog Elimination Act of 2000 (H.R. 4640, which became P.L. 106-546).

Creating a National Framework for Cybersecurity: An Analysis of Issues and Options

Description: Cyber- security refers to three things: measures to protect information technology; the information it contains, processes, and transmits, and associated physical and virtual elements (which together comprise cyberspace); the degree of protection resulting from application of those measures; and the associated field of professional endeavor. This report aims to examine what kind of national cyber-security framework may be needed and how it might be implemented, and it addresses three questions: 1. Where are the major cyber-security weaknesses currently, and where might weaknesses be anticipated in the future? What are the major means of leverage for addressing those weaknesses? What roles should government and the private sector play in the use of those means of leverage to address current and potential future weaknesses?

The Help America Vote Act and Election Administration: Overview and Issues

Description: The deadlocked November 2000 presidential election focused national attention on previously obscure details of election administration. Even before the U.S. Supreme Court had resolved the election in December, numerous bills to address the failings of the election system were introduced in Congress and state legislatures. The response at the federal level was the Help America Vote Act (HAVA; P.L. 107-252), enacted in 2002. HAVA created the Election Assistance Commission (EAC), established a set of election administration requirements, and provided federal funding, but did not supplant state and local control over election administration. Several issues have arisen or persisted in the years since HAVA was enacted. This report provides background information about HAVA and its provisions, the EAC, funding for the agency and for state programs to improve elections, and a number of enduring election administration issues.
