Gun Industry Liability: Lawsuits and Legislation

Description: This report discusses gun industry liability issues after the Maryland Court of Appeals announced that it was changing the common law "to hold the manufacturers and marketers of Saturday Night Special handguns strictly liable to innocent persons who suffer gunshot injuries from the criminal use of their products." Congressional Authority to Regulate Firearms: A Legal Overview

Description: Courts have been confronted with the question of whether federal laws can be applied to intrastate possession and intrastate transfers of firearms, or whether such application exceeds the authority of Congress. This report explores these cases and how courts have analyzed these as-applied challenges under the Supreme Court's Commerce Clause jurisprudence primarily set forth in United States v. Lopez.

Guns, Excise Taxes, and Wildlife Restoration

Description: As a result of the recent debate over guns, gun rights, and gun-related violence, there has been a marked increase in sales of many weapons as well as ammunition. Firearms at Army Corps Water Resource Projects: Proposed Legislation and Issues for Congress

Description: This report discusses issues for Congress regarding public safety and infrastructure security at water resource projects managed by the U.S. Army Corps of Engineers. Proposed legislation would bar the Secretary of the Army from promulgating or enforcing regulations that prohibit individuals from possessing firearms (including assembled or functional firearms) at Corps projects and instead require that firearms possession comply with state law.

Gun Control: "Bump-Fire" Stocks

Description: This report discusses "bump-fire" stocks for guns which allow less experienced users to shoot semiautomatic rifles more rapidly. Gun Control: Silencers Under the Hearing Protection Act (H.R. 3668)

Description: This report discusses the proposed "Hearing Protection Act" (A part of the Sportsmen's Heritage and Recreational Enhancement Act,H.R. 3668) which would take gun silencers out from under the jurisdiction of the National Firearms Act of 1934 (NFA) and have them regulated only by the Gun Control Act of 1968 (GCA). The NFA requires fingerprint based background checks, taxes various parts of the production process, requires sellers to be federally licensed, and silencers must be registered with ATF.

President Obama Announces Executive Actions to "Reduce Gun Violence"

Description: This report briefly discusses executive actions aimed at, among other things, "keep[ing] guns out of the wrong hands through background checks" and "mak[ing] our communities safer from gun violence." These actions include, for example, directing specified executive agencies to conduct or sponsor research into gun safety technology and finalizing a rule requiring firearms shippers to notify law enforcement of any firearms lost or stolen in transit.
