Gun Control: Statutory Disclosure Limitations on ATF Firearms Trace Data and Multiple Handgun Sales Reports

Description: This report briefly describes a provision known as the "Tiahrt" amendment, a rider on the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) appropriations that prohibits ATF from disclosing firearm trace data and multiple handgun sales reports data for any purpose other than supporting a criminal investigatoin or agency licensing proceeding. The Tiahrt amendment is so called because its sponsor is Representative Todd Tiahrt. A coalition of 210 city mayors favors the repeal of this rider, but there is much opposition to that motion.

The Brady Handgun Control Act: Constitutional Issues

Description: The Brady Handgun Control Act established a five-day waiting period for handgun purchases, during which local law enforcement can make reasonable efforts to conduct background checks in available records and block and sales to convicted felons and other disqualified persons. This report reviews the background of federal gun control legislation, analyzes the conflict in the courts over the constitutionality under the Tenth Amendment of the duties placed on local law enforcement, and considers the implications of the decisions for Brady Act enforcement.

The Assault Weapons Ban: Review of Federal Laws Controlling Possessions of Certain Firearms

Description: This report reviews the 1994 assault weapons ban, which is effective for ten years on 19 types of semiautomatic assault weapons. The Act builds upon a 60-year history of federal regulation of firearms. Federal Gun Control Laws: The Second Amendment and Other Constitutional Issues

Description: This report examines the historical, legal, and constitutional arguments for and against an individual right to bear firearms under the Second Amendment of the Constitution. Those who favor federal gun control laws tend to assert that the Second Amendment has been correctly interpreted by the courts to confer only a collective right, which may be exercised through state militias. Those who oppose gun control laws tend to assert that the Second Amendment should be interpreted to grant an individual right to bear arms for lawful purposes, subject to appropriately minimal restrictions.

Post-Heller Second Amendment Jurisprudence

Description: This report examines the scope of the Second Amendment, as interpreted by the federal circuit courts of appeals, after the watershed Supreme Court decisions in "District of Columbia v. Heller" and "McDonald v. City of Chicago". After "Heller" and "McDonald", numerous challenges were brought on Second Amendment grounds to various federal, state, and local firearm laws and regulations. Because Heller neither purported to define the full scope of the Second Amendment, nor suggested a standard of review for evaluating Second Amendment claims, the lower federal courts have been tasked with doing so in the Second Amendment challenges brought before them. This report discusses in detail notable post-Heller Second Amendment cases decided by federal courts of appeals. Because "Heller" and "McDonald" provide the only recent Supreme Court guidance on the Second Amendment, the analyses in these cases may provide useful guideposts for Congress should it seek to enact further firearm regulations.

President Obama Announces Executive Actions to "Reduce Gun Violence"

Description: This report briefly discusses executive actions aimed at, among other things, "keep[ing] guns out of the wrong hands through background checks" and "mak[ing] our communities safer from gun violence." These actions include, for example, directing specified executive agencies to conduct or sponsor research into gun safety technology and finalizing a rule requiring firearms shippers to notify law enforcement of any firearms lost or stolen in transit.

Gun Control: Federal Law and Legislative Action in the 114th Congress

Description: This report provides background on the two major federal gun control statutory frameworks: the National Firearms Act of 1934 (NFA), as amended, and the Gun Control Act of 1968 (GCA), as amended. It then provides analysis of the Senate amendments offered in the 114th Congress that would have addressed issues regarding expanding federal background check requirements to private non-licensed gun sellers in public places, allowing the Attorney General power to stop the sale of firearms or explosives to a person deemed "a dangerous terrorist", revising and codifying rules regarding people with mental health conditions acquiring firearms, and improving computer systems and the availability of information on persons not authorized to possess a firearm . It also tracks the status of gun control related appropriations for the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Federal Bureau of Investigation National Instant Criminal Background Check System (NICS) Section, National Criminal History Improvement Program (NCHIP), and NICS Amendments Record Improvement Program (NARIP).

Gun Control: "Bump-Fire" Stocks

Description: This report discusses "bump-fire" stocks for guns which allow less experienced users to shoot semiautomatic rifles more rapidly. "Bump-stocks" that contain a coiled spring are considered firearms by the ATF but other varieties of modified stocks that do not contain coiled springs are not classified as firearms and as such are unregulated. The shooter in the October 1, 2017 Las Vegas shooting used semiautomatic rifles with 'bump-stocks" which has led to renewed interest in their regulation in Congress.

Gun Control: Silencers Under the Hearing Protection Act (H.R. 3668)

Description: This report discusses the proposed "Hearing Protection Act" (A part of the Sportsmen's Heritage and Recreational Enhancement Act,H.R. 3668) which would take gun silencers out from under the jurisdiction of the National Firearms Act of 1934 (NFA) and have them regulated only by the Gun Control Act of 1968 (GCA). The NFA requires fingerprint based background checks, taxes various parts of the production process, requires sellers to be federally licensed, and silencers must be registered with ATF.
