Consultant subcontracting at the Idaho National Engineering Laboratory

Description: The Department of Energy (Department), Idaho Operations Office (ID) is responsible for ensuring that its management and operating (M&O) contractors subcontract consultant services in a manner most advantageous to the Department. The objectives of the audit were to determine whether consultant subcontracts were competitively and objectively awarded and whether these subcontracts supported the Idaho National Engineering Laboratory`s (INEL) mission. The audit showed that M&O contractors generally did not award consultant subcontracts competitively and objectively. Also, many of the subcontracts were awarded to former INEL employees, increasing the potential for conflicts of interest. These problems occurred because M&O contractors` internal controls did not ensure that sole source procurements were adequately justified and that potential conflicts of interest were avoided. By not competing consultant subcontracts the Department may not have obtained the most economical consultant services. Further, the fundamental fairness upon which such subcontracts were awarded to former employees was questionable. Additionally, one INEL M&O contractor was subcontracting consultant support services directly for Department Headquarters. This occurred because Headquarters elements and the M&O contractor did not follow Department guidance prohibiting subcontractual support from an M&O contractor directly to Headquarters. As a result, the M&O contractor acted as a procurement agent for Headquarters enabling Headquarters to avoid the more stringent requirements of the Department`s procurement process.

Department of Energy Voluntary Protection Program - Part IV: Onsite review handbook

Description: Onsite Review Handbook contains criteria to be used in evaluating the management systems required for initial or continued participation in the Department of Energy Voluntary Protection Program (DOE-VPP), verifying and calculating rates of injury experience, the Onsite Review report format, and sample questions to be used during onsite interviews. This document should be used in conjunction with the first three DOE-VPP manuals (Part I: Program Elements, Part II: Procedures Manual, and Part III: Application Guidelines). This document is intended to assist Onsite Review team members and DOE contractors in evaluating safety and health programs, and to serve as guidance for DOE-VPP participants in performing their required annual evaluation. Requests for additional information or any questions may be addressed to a DOE-VPP Coordinator in the Office of Occupational Safety and Health Policy. The term contractor used throughout this document refers to an applicant to, or a participant in, the DOE-VPP. The term subcontractor refers to any organization that is contracted by the applicant or participant to do work at the site under review. The DOE-VPP Onsite Review Criteria contained in Appendix A provide guidance for evaluating a site`s implementation of the program requirements given in Part I: Program Elements. The program requirements are in bold italicized type, followed by guidance for ensuring implementation. Part I should be consulted for a complete description of the program requirements. These criteria should be used by team members whenever possible, but are not intended to be all inclusive. Determination of adequate implementation of the DOE-VPP requirements is at the team members` discretion. Guidance for calculating recordable injury and lost workday incidence rates is contained in Appendix B. The OSHA injury/illness records review and the associated calculations should be performed by Onsite Review Team members during the pre-onsite planning visit.

Description: The primary objective of the Monitored Geologic Repository Project Description Document (PDD) is to allocate the functions, requirements, and assumptions to the systems at Level 5 of the Civilian Radioactive Waste Management System (CRWMS) architecture identified in Section 4. It provides traceability of the requirements to those contained in Section 3 of the ''Monitored Geologic Repository Requirements Document'' (MGR RD) (CRWMS M&O 2000b) and other higher-level requirements documents. In addition, the PDD allocates design related assumptions to work products of non-design organizations. The document provides Monitored Geologic Repository (MGR) engineering design basis in support of design and performance assessment in preparing for the Site Recommendation (SR) and License Application (LA) milestones. The engineering design basis documented in the PDD is to be captured in the System Description Documents (SDDs) which address each of the systems at Level 5 of the CRWMS architecture. The design engineers obtain the engineering design basis from the SDDs and by reference from the SDDs to the PDD. The design organizations and other organizations will obtain design related assumptions directly from the PDD. These organizations may establish additional assumptions for their individual activities, but such assumptions are not to conflict with the assumptions in the PDD. The PDD will serve as the primary link between the engineering design basis captured in the SDDs and the design requirements captured in U.S. Department of Energy (DOE) documents. The approved PDD is placed under Level 3 baseline control by the CRWMS Management and Operating Contractor (M&O) and the following portions of the PDD constitute the Technical Design Baseline for the MGR: the design characteristics listed in Table 2-1, the MGR Architecture (Section 4.1),the Engineering Design Bases (Section 5), and the Controlled Project Assumptions (Section 6).

Development of a Dispatchable PV Peak Shainv System. PV: Bonus Program - Phase 1 Report. Volume 1

Description: This report summarizes the work performed by Delmarva Power and Light and its subcontractors in Phase 1 of the US Department of Energy's PV:BONUS Program. The purpose of the program is to develop products and systems for buildings which utilize photovoltaic (N) technology. Beginning with a cooperative research effort with the University of Delaware's Center for Energy and Environmental Policy Research Delmarva Power developed and demonstrated the concept of Dispatchable PV Peak Shaving. This concept and the system which resulted horn the development work are unique from other grid-connected PV systems because it combines a PV, battery energy storage, power conversion and control technologies into an integrated package. Phase 1 began in July 1993 with the installation of a test and demonstration system at Delmarva's Northern Division General Office building near Newark, Delaware. Following initial testing throughout the summer and fall of 1993, significant modifications were made under an amendment to the DOE contract. Work on Phase 1 concluded in the early spring of 1995. Significant progress towards the goal of commercializing the system was made during Phase 1, and is summarized. Based on progress in Phase 1, a proposal to continue the work in Phase 2 was submitted to the US DOE in May 1995. A contract amendment and providing funds for the Phase 2 work is expected in July 1995.

Performance Measures for Evaluating Public Participation Activities in the Office of Environmental Management (DOE)

Description: Public participation in Office of Environmental Management (EM) activities throughout the DOE complex is a critical component of the overall success of remediation and waste management efforts. The challenges facing EM and its stakeholders over the next decade or more are daunting (Nuclear Waste News 1996). Achieving a mission composed of such challenges will require innovation, dedication, and a significant degree of good will among all stakeholders. EM's efforts to date, including obtaining and using inputs offered by EM stakeholders, have been notable. Public participation specialists have accepted and met challenges and have consistently tried to improve their performance. They have reported their experiences both formally and informally (e.g., at professional conferences and EM Public Participation Network Workshops, other internal meetings of DOE and contractor public participation specialists, and one-on-one consultations) in order to advance the state of their practice. Our research, and our field research in particular (including our interactions with many representatives of numerous stakeholder groups at nine DOE sites with diverse EM problems), have shown that it, is possible to develop coherent results even in a problem domain as complex as that of EM. We conclude that performance-based evaluations of public participation appear possible, and we have recommended an approach, based on combined and integrated multi-stakeholder views on the attributes of successful public participation and associated performance indicators, that seems workable and should be acceptable to diverse stakeholders. Of course, as an untested recommendation, our approach needs the validation that can only be achieved by application (perhaps at a few DOE sites with ongoing EM activities). Such an application would serve to refine the proposed approach in terms of its clarity, its workability, and its potential for full-scale use by EM and, potentially, other government agencies and private sector concerns.

Plutonium Can-In-Canister-Design Basis Event Analysis

Description: The purpose of this document is to perform a preliminary design basis event (DBE) analysis of the immobilized plutonium (can-in-canister) waste form to be referred to in this analysis as high level waste/plutonium (HLW/Pu). The objective of the analysis is to determine any preclosure safety impacts of the waste form on the Monitored Geologic Repository (MGR). The scope of this analysis is to determine the offsite dose consequences and associated frequencies of selected DBEs for systems handling disposable canisters that bound all surface and subsurface off-normal events, and to compare these results against regulatory limits. The results of this work are preliminary and are intended to be used to establish a set of preliminary MGR and waste form requirements, to identify mitigation or prevention options that may be required to meet regulatory limits, and to provide input to the Site Recommendation (SR) report. This document is prepared in accordance with the associated development plan (Civilian Radioactive Waste Management System Management and Operating Contractor [CRWMS M&O] 1999e).

Unsaturated Zone Flow Patterns and Analysis

Description: This Analysis/Model Report (AMR) documents the development of an expected-case model for unsaturated zone (UZ) flow and transport that will be described in terms of the representativeness of models of the natural system. The expected-case model will provide an evaluation of the effectiveness of the natural barriers, assess the impact of conservatism in the Total System Performance Assessment (TSPA), and support the development of further models and analyses for public confidence building. The present models used in ''Total System Performance Assessment for the Site Recommendation'' (Civilian Radioactive Waste Management System Management and Operating Contractor (CRWMS M&O) 2000 [1532461]) underestimate the natural-barrier performance because of conservative assumptions and parameters and do not adequately address uncertainty and alternative models. The development of an expected case model for the UZ natural barrier addresses issues regarding flow-pattern analysis and modeling that had previously been treated conservatively. This is in line with the Repository Safety Strategy (RSS) philosophy of treating conservatively those aspects of the UZ flow and transport system that are not important for achieving regulatory dose (CRWMS M&O 2000 [153246], Section 1.1.1). The development of an expected case model for the UZ also provides defense-in-depth in areas requiring further analysis of uncertainty and alternative models. In general, the value of the conservative case is to provide a more easily defensible TSPA for behavior of UZ flow and transport processes at Yucca Mountain. This AMR has been prepared in accordance with the ''Technical Work Plan for Unsaturated Zone (UZ) Flow and Transport Process Model Report'' (Bechtel SAIC Company (BSC) 2001 [155051], Section 1.3 - Work Package 4301213UMG). ESF AS-BUILT CONFIGURATION

Description: The calculations contained in this document were developed by the ''Mining Group of the Design & Engineering Organization'' and are intended solely for the use of the ''Design & Engineering Organization'' in its work regarding the subsurface repository. Yucca Mountain Project personnel from the ''Mining Group'' should be consulted before use of the calculations for purposes other than those stated herein or use by individuals other than authorized personnel in the ''Design & Engineering Organization''. The purpose of this calculation is to provide design inputs that can be used to develop an as-built drawing of the Exploratory Studies Facility (ESF) for the planning and development of the subsurface repository. This document includes subsurface as-built surveys, recommendation to complete as-built surveys, and Management and Operating Contractor (M&O) Subsurface Design Drawings as inputs. This calculation is used to provide data and information for an as-built ESF subsurface drawing and is not used in the development of results or conclusions, therefore all inputs are considered as indirect.

Seismic tomography Technology for the Water Infiltration Experiment

Description: NSA Engineering, Inc., conducted seismic tomography surveys in Niche No.3 in the Exploratory Studies Facility (ESF), Yucca Mountain, Nevada, and Alcove No.8 in the Enhanced Characterization of the Repository Block (ECRB) cross drift as part of the Infiltration Experiment being conducted in Niche No.3. NSA Engineering is a direct support contractor to the Yucca Mountain Project. This report documents the work performed from August 14 through 30, 2000, prior to the beginning of the infiltration experiment. The objective of the seismic tomography survey was to investigate the flow path of water between access drifts and more specifically to (Kramer 2000): (1) Conduct a baseline seismic tomography survey prior to the infiltration experiment; (2) Produce 2-D and 3-D tomographic images of the rock volume between Alcove No.8 and Niche No.3; (3) Correlate tomography results with published structural and lithological features, and with other geophysical data such as ground penetrating radar (GPR); and (4) Results of this survey will form a baseline with which to compare subsequent changes to the rock mass. These changes may be as a result of the water infiltration tests that could be conducted in Alcove No.8 in 2001. The scope of this reported work is to use the velocity tomograms to: (a) assess the structures and lithologic features within the surveyed area and/or volume between the two access drifts; and (b) provide information on the structural state of the rock mass as inferred by the velocity signatures of the rock prior to the beginning of the infiltration experiment.

FY 2000 Saltcake Dissolution and Feed Stability Workshop

Description: The Tanks Focus Area (TFA) continues to work closely with the Office of River Protection (ORP) to better understand the chemistry involved with the retrieval, transport, and pretreatment of nuclear wastes at Hanford. Since a private contractor is currently responsible for the pretreatment and immobilization activities in this remediation effort, the TFA has concentrated on saltcake dissolution and waste transport at the request of the ORP. Researchers at Hanford have performed a series of dissolution experiments on actual saltcake samples. Staff members at Mississippi State University (MSU) continue to model the dissolution results with the Environmental Simulation Program (ESP), which is used extensively by ORP personnel. Several ways to improve the predictive capabilities of the ESP were identified. Since several transfer lines at Hanford have become plugged, TFA tasks at AEA Technologies, Florida International University (FIU), MSU, and Oak Ridge National Laboratory (ORNL) are investigating the behavior of the supernatants and slurries during transport. A combination of experimental and theoretical techniques is used to study the transport chemistry. This effort is expected to develop process control tools for waste transfer. The results from these TFA tasks were presented to ORP personnel during the FY 2000 Saltcake Dissolution and Feed Stability Workshop, which was held on May 16-17 in Richland, Washington. The minutes from this workshop are provided in this report.

US Department of Energy Office of Inspector General report on audit of program administration by the Office of Energy Research

Description: The objective of the audit was to determine whether Energy Research had established performance expectations, including performance criteria and metrics, and used these expectations to monitor progress for basic and applied research performed at the Department`s national laboratories. Congressional and Departmental initiatives envision improved contract and program performance by requiring program managers to set measurable performance expectations. Even though research outcomes are inherently unpredictable, performance expectations can and should be established for scopes of work, milestones, resource limits and deliverables. However, Energy Research generally did not clearly specify--at either an aggregated program or individual task level--such expectations for research at the Department`s national laboratories. While information was available in the contractor`s research proposals, Energy Research essentially relied on the contractors to initiate and execute the research without agreement on expectations. This practice provided the Department with little basis to measure and evaluate contractor performance. Energy Research agreed in part with the finding and will take action on the recommendations in the report.

U.S. Department of Energy Office of Inspector General report on audit of acquisition of scientific research at Ames Laboratory

Description: The Department awards grants and cooperative agreements and contracts to sponsor scientific research at colleges and universities. Compared to cooperative agreements, contracts, particularly management and operating contracts, often impose duplicative and/or unnecessary administrative and compliance burdens on a college or university. Since the Department bears the cost of those additional burdens, the authors audited the cost effectiveness of the Department`s sponsorship of research at Ames Laboratory under a management and operating contract with Iowa State University. The research conducted at Ames is of the type that Congress intended to be sponsored by assistance agreements, rather than contracts. Moreover, they found the contract for managing and operating Ames Laboratory caused micromanagement and unnecessary costs, most of which could have been avoided with a cooperative agreement. However, after completion of the field work, the Department announced initiatives to reduce or eliminate some compliance and oversight burdens associated with management and operating contracts, but did not opt to sponsor research under cooperative agreements. The authors are unable to determine the monetary impact because the initiatives have not been implemented. Nevertheless, they continue to believe that cooperative agreements, having fewer unique bureaucratic requirements, offer the potential for reducing administrative overhead.

U.S. Department of Energy Office of Inspector General report on inspection of analytical laboratories oversight at the Strategic Petroleum Reserve

Description: The Department of Energy`s (DOE) Assistant Secretary for Fossil Energy has overall programmatic responsibility for the Strategic Petroleum Reserve (SPR). The SPR Project Management Office (SPRPMO), located in New Orleans, Louisiana, and under the direction of the Project Manager, manages day-to-day project activities. The SPR currently has five underground crude oil storage facilities, and one marine terminal, on or near the Gulf Coasts of Texas and Louisiana. The purpose of this inspection was to review oversight of M and O and subcontractor laboratories performing analyses on samples taken for SPR environmental compliance and oil quality purposes. During this inspection, the M and O contractor operated on-site environmental laboratories at four of the SPR storage facilities, and oil quality laboratories at two of the facilities. The number of subcontractor laboratories varies depending on the need for analytical support. The objective of this inspection was to determine if the SPRPMO had implemented management systems to provide adequate oversight of M and O contractor analytical laboratory activities, as well as to ensure effective oversight of subcontractor analytical laboratories.
