CRS Memo, "Base Realignment and Closure of National Guard Facilities: Application of 10 U.S.C. § 18238 and 32 U.S.C. § 104(c)"

Description: Legal memorandum prepared by the Congressional Research Service (CRS) dated 6 Jul 05. The Defense Base Closure and Realignment Act of 1990 has been amended to authorize a new round of base realignment and closure (BRAC) actions in 2005. Consistent with the law, the Department of Defense (DOD) has prepared a list of candidate military installations for closure or realignment actions. Among these installations are several Air National Guard and Army National Guard facilities. Two provisions of law, 10 U.S.C. § 18238 and 32 U.S.C. § 104(c), have been seen as impediments to BRAC actions at these facilities. The application of these provisions to the BRAC process is the subject of this memorandum.

GAO Report 05-785: Analysis of DOD’s 2005 Selection Process and Recommendations for Base Closures and Realignments (1Jul 05)

Description: The law requires that the Government Accountability Office (GAO) issue a report on the Department of Defense’s (DOD) recommendations and selection process by July 1, 2005. GAO’s objectives were to (1) determine the extent to which DOD’s proposals achieved its stated BRAC goals, (2) analyze whether the process for developing recommendations was logical and reasoned, and (3) identify issues with the recommendations that may warrant further attention. Time constraints limited GAO’s ability to examine implementation details of most of the individual recommended actions.

The Army Basing Study 2005 - (COBRA) Cost of Base Realignment Action

Description: Disregard restriction header and footer -This is the report on our audit of the Cost of Base Realignment Action (COBRA) model. We performed this audit as part of our overall audit of the 2005 Army Basing Study. We will include the results of this audit in a summary report at the end of the study. Our conclusions are positive; thus we are making no recommendations and the report is not subject to the command-reply process that Army Regulation 36-2 prescribes. However, we have incorporated the official Army position on our conclusions in Annex C.

Description: Disregard restriction header and footer - The Director, The Army Basing Study (TABS) asked that we evaluate the Army’s process for collecting certified installation and leased facility military value data as part of our audit support for TABS 2005. We focused our effort on determining whether: The 2005 Army Basing Study Group had a sound process in place to collect certified military value data that was adequately supported with appropriate evidentiary matter and was accurate. Management controls were in place and operating for the military value data call.
