Clean Power Plan: Legal Background and Pending Litigation in West Virginia v. EPA

Description: This report provides legal background on the Clean Power Plan rule (CPP or Rule) to regulate emissions of greenhouse gases (GHGs), its Clean Air Act (CAA) framework under Section 111, and climate-related lawsuits that have preceded the present litigation over the CPP. Perchlorate Contamination of Drinking Water: Regulatory Issues and Legislative Actions

Description: This report reviews perchlorate contamination issues and related developments. Perchlorate is the explosive component of solid rocket fuel, fireworks, road flares, and other products. Used heavily by the Department of Defense (DOD) and related industries, perchlorate also occurs naturally and is present in some organic fertilizer. This soluble, persistent compound has been detected in drinking water supplies, especially in California. It also has been found in milk and many foods.

Clean Air Act Issues in the 107th Congress

Description: In the 107th Congress, the most prominent air quality issue has been whether state and federal regulations designed to protect air quality are having a negative impact on energy production, and, if so, whether legislation should be enacted to reform such regulations. The early discussion focused primarily on California, but with the release of the Administration’s energy policy recommendations in May 2001 and subsequent congressional action, attention shifted to issues more national in scope.
