Unique Identification Codes for Federal Contractors: DUNS Numbers and CAGE Codes

Description: This report focuses on identification numbers for government acquisition and acquisition-related purposes that government contractors, generally, are required to have. The federal government uses a proprietary system, Dun & Bradstreet's (D&B's) Data Universal Numbering System (DUNS), to uniquely identify the entities with which it does business. It does not address taxpayer identification numbers (TINs) or other types of recipients of federal money (e.g., grant award recipients) who are required to obtain DUNS numbers.

Sourcing Policy: Statutes and Statutory Provisions

Description: This report discusses the federal government's sourcing policy, which dates to the 1950s with the publication of three Bureau of the Budget bulletins. Congressional interest and involvement in sourcing policy, as measured by legislation that has been enacted, has grown over the years. Recently enacted provisions have addressed, for example, protest rights for federal government employees, funding limits on competitive sourcing activities, the development of a single consistent definition of “inherently governmental,” and the development of “insourcing” guidelines.

Description: As a general rule, government agencies contract with the lowest qualified responsible bidder or offeror. Debarment and suspension are among the techniques that government agencies use to ensure that they contract with only "responsible" bidders or offerors because they allow the government to exclude contractors from receiving government contracts. This report focuses upon exclusions on procurement grounds.2 It surveys the authorities requiring or allowing federal agencies to debar or suspend contractors, due process and other protections for contractors, and recently enacted and proposed amendments to the laws governing debarment and suspension.

Private Security Contractors in Iraq: Background, Legal Status, and Other Issues

Description: This report summarizes what is currently known publicly about companies that provide personnel for security missions in Iraq and some sources of controversy surrounding them. A treatment of legal status and authorities follows, including an overview of relevant international law as well as Iraqi law, which currently consists primarily of Coalition Provisional Authority (CPA) orders that remain in effect until superceded. The various possible means for prosecuting contractors under U.S. law in civilian or military courts are detailed, followed by a discussion of possible issues for Congress, including whether protective services are inherently governmental functions. The report also summarizes pertinent legislative proposals.
