Hanford Site Groundwater Monitoring for Fiscal Year 2006

Description: This report presents the results of groundwater monitoring for FY 2006 on DOE's Hanford Site. Results of groundwater remediation, vadose zone monitoring, and characterization are summarized. DOE monitors groundwater at the Hanford Site to fulfill a variety of state and federal regulations, including the Atomic Energy Act (AEA), the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), and Washington Administrative Code (WAC).

HANFORD TANK FARM RESOURCE CONVERVATION & RECOVERY ACT (RCRA) CORRECTIVE ACTION PROGRAM

Description: As a consequence of producing special nuclear material for the nation's defense, large amounts of extremely hazardous radioactive waste was created at the US Department of Energy's (DOE) Hanford Site in south central Washington State. A little over 50 million gallons of this waste is now stored in 177 large, underground tanks on Hanford's Central Plateau in tank farms regulated under the Atomic Energy Act and the Resource, Conservation, and Recovery Act (RCRA). Over 60 tanks and associated infrastructure have released or are presumed to have released waste in the vadose zone. In 1998, DOE's Office of River Protection established the Hanford Tank Farm RCRA Corrective Action Program (RCAP) to: (1) characterize the distribution and extent of the existing vadose zone contamination; (2) determine how the contamination will move in the future; (3) estimate the impacts of this contamination on groundwater and other media; (4) develop and implement mitigative measures; and (5) develop corrective measures to be implemented as part of the final closure of the tank farm facilities. Audit Report on "Work for Others Performed by the Department of Energy for the Department of Defense"

Description: Pursuant to the Atomic Energy Act of 1954, as amended, and the Economy Act of 1932, the Department of Energy and its semi-autonomous National Nuclear Security Administration (NNSA) provide research and technical assistance to other Federal agencies on a reimbursable, full cost recovery basis through the Work for Others (WFO) program. For the vast majority of WFO technical projects, Department Federal officials furnish administrative project oversight while the actual detailed scientific or technical work is completed by the Department's 'management and operating' contractors. These contractors are awarded a special contract type specifically created under the Federal Acquisition Regulation to manage and operate Department sites and facilities, including sophisticated laboratories and technical centers, on a government-owned, contractor-operated basis. With annual expenditures exceeding $1 billion, the Department of Defense (DoD) is one of the Department's largest WFO customers. Work performed for DoD at the Department's national laboratories and other facilities includes highly technical research in areas such as nuclear weapons systems, counter-terrorism, and in-theater troop support. The National Defense Authorization Act for Fiscal Year (FY) 2009, required the Inspectors General of the DoD and the Department to review procurement methods to determine whether the Department complied with DoD procurement requirements and/or whether alternative procurement policies were in place. In response, we focused our review on projects performed by NNSA because it completes the vast majority (approximately $900 million in FY 2008) of the Department's work for DoD. As part of this effort, and, at the specific request of the DoD Office of Inspector General (DoD OIG), we identified the universe of WFO technical projects that received new funding in the fourth quarter of FY 2008 at NNSA sites. History of US nuclear weapon safety assessment: The early years

Description: From the beginnings of the U.S. nuclear weapons program, military and civilian dual- agency judgment has been fundamental to achieving nuclear weapon and weapon system safety. This interaction was initiated by the Atomic Energy Act of 1946, which created the Atomic Energy Commission (AEC). The principle of using dual-agency judgment has been perpetuated in the design and assessment of the weapon and weapon system acceptance process since that time. This fundamental approach is still used today in all phases of the weapon life. In this paper, an overview of the history and philosophy of the approach is described.

Standard review plan on antitrust reviews. Final report

Description: This standard review plan describes the procedures used by NRC staff to implement the antitrust review and enforcement provisions in Sections 105 and 186 of the Atomic Energy Act of 1954, as amended (the Act), and replaces NUREG-0970. These procedures are principally derived from the Commission`s Rules and Regulations in 10 CFR Sections 2.101, 2.102, Part 2-Appendix A, Section X, 50.33a, 50.80, 50.90, and 52.77. These procedures set forth the steps and criteria the staff uses in antitrust reviews of construction permit applications, operating license applications, combined construction permit/operating license applications, combined construction permit/operating license applications, and applications for approval of the transfer of construction permits, operating licenses, and combined licenses. In addition, the procedures describe how the staff enforces compliance with antitrust conditions appended to licenses.

Soil Management Plan for the Oak Ridge Y-12 National Security Complex Oak Ridge, Tennessee

Description: This Soil Management Plan applies to all activities conducted under the auspices of the National Nuclear Security Administration (NNSA) Oak Ridge Y-12 National Security Complex (Y-12) that involve soil disturbance and potential management of waste soil. The plan was prepared under the direction of the Y-12 Environmental Compliance Department of the Environment, Safety, and Health Division. Soil disturbances related to maintenance activities, utility and building construction projects, or demolition projects fall within the purview of the plan. This Soil Management Plan represents an integrated, visually oriented, planning and information resource tool for decision making involving excavation or disturbance of soil at Y-12. This Soil Management Plan addresses three primary elements. (1) Regulatory and programmatic requirements for management of soil based on the location of a soil disturbance project and/or the regulatory classification of any contaminants that may be present (Chap. 2). Five general regulatory or programmatic classifications of soil are recognized to be potentially present at Y-12; soil may fall under one or more these classifications: (a) Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) pursuant to the Oak Ridge Reservation (ORR) Federal Facilities Agreement; (b) Resource Conservation and Recovery Act (RCRA); (c) RCRA 3004(u) solid waste managements units pursuant to the RCRA Hazardous and Solid Waste Amendments Act of 1984 permit for the ORR; (d) Toxic Substances and Control Act-regulated soil containing polychlorinated biphenyls; and (e) Radiologically contaminated soil regulated under the Atomic Energy Act review process. Covenant Deferral Request for the Proposed Transfer of Land Parcel ED-8 at the East Tennessee Technology Park, Oak Ridge, Tennessee - Final - May 2009

Description: The United States Department of Energy (DOE) is proposing to transfer a land parcel (hereinafter referred to as 'the Property') designated as Land Parcel ED-8 at the East Tennessee Technology Park (ETTP) in Oak Ridge, Tennessee, by deed, and is submitting this Covenant Deferral Request (CDR) pursuant to Section 120(h)(3)(C) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended, and applicable U. S. Environmental Protection Agency (EPA) guidance. The Oak Ridge Reservation (ORR), which includes ETTP, was placed on the National Priorities List (NPL) in November 1989. Environmental investigation and cleanup activities are continuing at ETTP in accordance with CERCLA, the National Contingency Plan (NCP), and the Federal Facility Agreement (FFA). The FFA was entered into by the DOE-Oak Ridge Office (ORO), EPA Region 4, and the Tennessee Department of Environment and Conservation (TDEC) in 1991. The FFA establishes the schedule and milestones for environmental remediation of the ORR. The proposed property transfer is a key component of the Oak Ridge Performance Management Plan (ORPMP) for accelerated cleanup of the ORR. DOE, using its authority under Section 161(g) of the Atomic Energy Act of 1954 (AEA), proposes to transfer the Property to Heritage Center, LLC, a subsidiary of the Community Reuse Organization of East Tennessee (CROET), hereafter referred to as 'Heritage Center.' CROET is a 501(c)(3) not-for-profit corporation established to foster the diversification of the regional economy by re-utilizing DOE property for private-sector investment and job creation. Licensing plan for UMTRA project disposal sites. Final [report]

Description: The Uranium Mill Tailings Remedial Action (UMTRA) Project Office developed a plan to define UMTRA Project licensing program objectives and establish a process enabling the DOE to document completion of remedial actions in compliance with 40 CFR 1 92 and the requirements of the NRC general license. This document supersedes the January 1987 Project Licensing Plan (DOE, 1987). The plan summarizes the legislative and regulatory basis for licensing, identifies participating agencies and their roles and responsibilities, defines key activities and milestones in the licensing process, and details the coordination of these activities. This plan provides an overview of the UMTRA Project from the end of remedial actions through the NRC`s acceptance of a disposal site under the general license. The licensing process integrates large phases of the UMTRA Project. Other programmatic UMTRA Project documents listed in Section 6.0 provide supporting information.

CHALLENGES WITH RETRIEVING TRANSURANIC WASTE FROM THE HANFORD BURIAL GROUNDS

Description: The U.S. DOE's Hanford Reservation produced plutonium and other nuclear materials for the nation's defense starting in World War II. The defense mission generated wastes that were either retrievably stored (i.e. retrievably stored waste) and/or disposed of in burial grounds. Challenges have emerged from retrieving suspect TRU waste including adequacy of records, radiological concerns, container integrity, industrial hygiene and safety issues, the lack of processing/treatment facilities, and the integration of regulatory requirements. All retrievably stored waste is managed as mixed waste and assumed to be TRU waste, unless documented otherwise. Mixed waste is defined as radioactive waste that contains hazardous constituents. The Atomic Energy Act governs waste with radionuclides, and the Resource Conservation and Recovery Act (RCRA) governs waste with hazardous constituents. Waste may also be governed by the Toxic Substances Control Act (TSCA), and a portion may be managed under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). In 1970, TRU waste was required to be placed in 20-year retrievable storage and segregated from other Waste. Prior to that date, segregation did not occur. Because of the changing definition of TRU over the years, and the limitations of early assay equipment, all retrievably stored waste in the burial grounds is managed as suspect TRU. Experience has shown that some of this waste will be characterized as low-level (non-TRU) waste after assay. The majority of the retrieved waste is not amenable to sampling due to waste type and/or radiological issues. Key to waste retrieval and disposition are characterization, historical investigation and research, knowledge of past handling and packaging, as well as a broad understanding and application of the regulations.

HANFORD SITE RIVER PROTECTION PROJECT (RPP) TANK FARM CLOSURE

Description: The U. S. Department of Energy, Office of River Protection and the CH2M HILL Hanford Group, Inc. are responsible for the operations, cleanup, and closure activities at the Hanford Tank Farms. There are 177 tanks overall in the tank farms, 149 single-shell tanks (see Figure 1), and 28 double-shell tanks (see Figure 2). The single-shell tanks were constructed 40 to 60 years ago and all have exceeded their design life. The single-shell tanks do not meet Resource Conservation and Recovery Act of 1976 [1] requirements. Accordingly, radioactive waste is being retrieved from the single-shell tanks and transferred to double-shell tanks for storage prior to treatment through vitrification and disposal. Following retrieval of as much waste as is technically possible from the single-shell tanks, the Office of River Protection plans to close the single-shell tanks in accordance with the Hanford Federal Facility Agreement and Consent Order [2] and the Atomic Energy Act of 1954 [3] requirements. The double-shell tanks will remain in operation through much of the cleanup mission until sufficient waste has been treated such that the Office of River Protection can commence closing the double-shell tanks. At the current time, however, the focus is on retrieving waste and closing the single-shell tanks. The single-shell tanks are being managed and will be closed in accordance with the pertinent requirements in: Resource Conservation and Recovery Act of 1976 and its Washington State-authorized Dangerous Waste Regulations [4], US DOE Order 435.1 Radioactive Waste Management [5], the National Environmental Policy Act of 1969 [6], and the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 [7]. RCRA Part B Permit Application for the Idaho National Engineering Laboratory - Volume 5 Radioactive Waste Management Complex

Description: This section of the Radioactive Waste Management Complex (RWMC) Part B permit application describes the waste characteristics Of the transuranic (TRU) mixed wastes at the RWMC waste management units to be permitted: the Intermediate-Level Transuranic Storage Facility (ILTSF) and the Waste Storage Facility (WSF). The ILTSF is used to store radioactive remote-handled (RH) wastes. The WSF will be used to store radioactive contact-handled (CH) wastes. The Transuranic Storage Area (TSA) was established at the RWMC to provide interim storage of TRU waste. Department of Energy (DOE) Order 5820.2A defines TRU waste as waste contaminated with alpha-emitting transuranium radionuclides with half-lives greater than 20 years in concentrations greater than 100 nanocuries per gram (nCi/g) o f waste material. The TSA serves generators both on and off the Idaho National Engineering Laboratory (INEL). The ILTSF is located at the TSA, and the WSF will be located there also. Most of the wastes managed at the TSA are mixed wastes, which are radioactive wastes regulated under the Atomic Energy Act (AEA) that also contain hazardous materials regulated under the Resource Conservation and Recovery Act (RCRA) and the Idaho Hazardous Waste Management Regulations. These wastes include TRU mixed wastes and some low-level mixed wastes. Accordingly, the TSA is subject to the permitting requirements of RCRA and the Idaho Administrative Procedures Act (IDAPA). Prior to 1982, DOE orders defined TRU wastes as having transuranium radionuclides in concentrations greater than 10 nCi/g, The low-level mixed wastes managed at the TSA are those wastes with 10 to 100 nCi/g of TRU radionuclides that prior to 1982 were considered TRU waste.

Characterization of the Nuclear Barge Sturgis

Description: The Department of the Army is authorized to build and operate nuclear reactors for defense purposes under Paragraph 91b of the Atomic Energy Act of 1954 (1). As part of the Army Reactor Program, the United States Army Corps of Engineers (Corps) is responsible for nuclear reactor engineering and design, reactor construction, and decommissioning design and implementation (2). The Corps is currently focused on ensuring the safety and security of the Army's three deactivated power reactors and planning for their final decommissioning. To support decommissioning cost projections, the Corps is gathering information on the residual radiological and chemical hazards associated with each reactor, starting with the MH-1A reactor on the Sturgis Barge (3). Because the Sturgis Barge is moored in the James River Reserve Fleet, there were unique challenges that had to be overcome during the characterization survey and others that will become a concern when final decommissioning is to be per formed.
