Intellectual Property: Law & the Information Society—Cases and Materials

Description: This book is an introduction to intellectual property law, the set of private legal rights that allows individuals and corporations to control intangible creations and marks—from logos to novels to drug formulae—and the exceptions and limitations that define those rights. It focuses on the three graphmain forms of US federal intellectual property—trademark, copyright and patent—but many of the ideas discussed here apply far beyond those legal areas and far beyond the law of the United States. The book is intended to be a textbook for the basic Intellectual Property class, but because it is an open coursebook, which can be freely edited and customized, it is also suitable for an undergraduate class, or for a business, library studies, communications or other graduate school class. Each chapter contains cases and secondary readings and a set of problems or role-playing exercises involving the material. The problems range from a video of the Napster oral argument to counseling clients about search engines and trademarks, applying the First Amendment to digital rights management and copyright or commenting on the Supreme Court’s new rulings on gene patents.

Changing the Tune: The Kansas City Women’s Jazz Festival, 1978-1985

Description: Even though the potential passage of the Equal Rights Amendment had cracked glass ceilings across the country, in 1978 jazz remained a boys’ club. Two Kansas City women, Carol Comer and Dianne Gregg, challenged that inequitable standard. With the support of jazz luminaries Marian McPartland and Leonard Feather, inaugural performances by Betty Carter, Mary Lou Williams, an unprecedented All-Star band of women, Toshiko Akiyoshi’s band, plus dozens of Kansas City musicians and volunteers, a casual conversation between two friends evolved into the annual Kansas City Women’s Jazz Festival (WJF). But with success came controversy. Anxious to satisfy fans of all jazz styles, WJF alienated some purists. The inclusion of male sidemen brought on protests. The egos of established, seasoned players unexpectedly clashed with those of newcomers. Undaunted, Comer, Gregg, and WJF’s ensemble of supporters continued the cause for eight years. They fought for equality not with speeches but with swing, without protest signs but with bebop. For the first book about this groundbreaking festival, Carolyn Glenn Brewer interviewed dozens of people and dove deeply into the archives. This book is an important testament to the ability of two friends to emphatically prove jazz genderless, thereby changing the course of jazz history. Description: This document is a technical Recommendation for use in developing a broader consensus on what is required for an archive to provide permanent, or indefinite long-term, preservation of digital information. This Recommendation establishes a common framework of terms and concepts which comprise an Open Archival information System (OAIS). It allows existing and future archives to be more meaningfully compared and contrasted. It provides a basis for further standardization within an archival context and it should promote greater vendor awareness of, and support of, archival requirements. Through the process of normal evolution, it is expected that expansion, deletion, or modification of this document may occur. This Recommendation is therefore subject to CCSDS document management and change control procedures which are defined in Procedures Manual for the Consultative Committee for Space Data Systems. Audit and Certification of Trustworthy Digital Repositories: Recommended Practice, Issue 1

Description: This document is a technical Recommendation to use as the basis for providing audit and certification of the trustworthiness of digital repositories. It provides a detailed specification of criteria by which digital repositories shall be audited. The OAIS Reference Model contained a roadmap which included the need for a certification standard. The initial work was to be carried out outside CCSDS and then brought back into CCSDS to take into the standard. In 2003, Research Libraries Group (RLG) and the National Archives and Records Administration (NARA) created a joint task force to specifically address digital repository certification. That task force published Trustworthy Repositories Audit & Certification: Criteria and Checklist (TRAC—reference [B3]), on which this Recommended Practice is based. Through the process of normal evolution, it is expected that expansion, deletion, or modification of this document may occur. Economics: From the Dismal Science to the Moral Science: The Moral Economics of Kendall P. Cochran

Description: Adam Smith published The Theory of Moral Sentiments in 1759 and established the ethical foundation for The Wealth of Nations (1776) as well as the important role played by custom and fashion in shaping behaviors and outcomes. Kendall P. Cochran believed in Smith’s emphasis on value-driven analysis and seeking solutions to major problems of the day. Cochran believed that economists moved too far in the direction of analysis free of words like ought and should and devoted his career to establishing that economics is a moral science. A recent study by two Harvard professors, Carmen Reinhart and Kenneth Rogoff, Growth in a Time of Debt (2010), asserted that healthy economic growth and high levels of government debt are incompatible. These conclusions are associated with the austerity movement, which calls for policymakers to reduce government spending in order to reduce the government’s debt and improve long-term growth prospects. The austerity movement has been used to justify the sharp decline in public sector employment that has restrained job growth since the recession of 2007. In 2013, a graduate student named Thomas Herndon discovered an error in the calculations of Reinhart and Rogoff, publishing his findings in a paper co-authored by his professors, called "Does High Public Debt Consistently Stifle Economic Growth? A Critique of Reinhart and Rogoff." These findings call the entire austerity movement into question, causing many to reconsider the current obsession with reducing the government debt during a time of economic stagnation. Cochran would have held a celebration to toast Herndon and his professors for their work, not only for the sake of technical accuracy, but also because the policy prescriptions associated with the austerity movement are misguided and harmful to the unemployed and underemployed during times of economic hardship. Graham Barnett: A Dangerous Man

Description: Graham Barnett was killed in Rankin, Texas, on December 6, 1931. His death brought an end to a storied career, but not an end to the legends that claimed he was a gunman, a hired pistolero on both sides of the border, a Texas Ranger known for questionable shootings in Company B under Captain Fox, a deputy sheriff, a bootlegger, and a possible “fixer” for both law enforcement and outlaw organizations. In real life he was a good cowboy, who provided for his family the best way he could, and who did so by slipping seamlessly between the law enforcement community and the world of illegal liquor traffickers. Stories say he killed unnumbered men on the border, but he stood trial only twice and was acquitted both times. Barnett lived in the twentieth century but carried with him many of the attitudes of old frontier Texas. Among those beliefs was that if there were problems, a man dealt with them directly and forcefully—with a gun. His penchant to settle a score with gunplay brought him into confrontation with Sheriff W. C. Fowler, a former friend, who shot Barnett with the latter’s own submachine gun on loan. Participatory Design in Academic Libraries: New Reports and Findings

Description: This report looks at how staff at eight academic institutions gained new insight about how students and faculty use their libraries, and how the staff are using these findings to improve library technologies, space, and services. Participatory design is a relatively recent approach to understanding library user behavior. It is based on techniques used in anthropological and ethnographic observation. The report is based on a series of presentations at the second CLIR Seminar on Participatory Design of Academic Libraries, held at the University of Rochester’s River Campus June 5-7, 2013. Chapters focus on projects at the University of Colorado, Boulder; Colby College; University of Connecticut; Columbia University; Rush University Medical Center; Purdue University; Northwestern University; and the University of Rochester. David Lindahl, of the University of Missouri-Kansas City, provided the keynote.

The Digital Public Domain: Foundations for an Open Culture

Description: Digital technology has made culture more accessible than ever before. Texts, audio, pictures and video can easily be produced, disseminated, used and remixed using devices that are increasingly user-friendly and affordable. However, along with this technological democratization comes a paradoxical flipside: the norms regulating culture's use — copyright and related rights — have become increasingly restrictive. This book brings together essays by academics, librarians, entrepreneurs, activists and policy makers, who were all part of the EU-funded Communia project. Together the authors argue that the Public Domain — that is, the informational works owned by all of us, be that literature, music, the output of scientific research, educational material or public sector information — is fundamental to a healthy society. The essays range from more theoretical papers on the history of copyright and the Public Domain, to practical examples and case studies of recent projects that have engaged with the principles of Open Access and Creative Commons licensing.

Repository Planning Checklist and Guidance

Description: This document introduces the Planning Tool for Trusted Electronic Repositories (PLATTER) toolkit which assists repositories in setting the necessary objectives and targets for achieving trustworthiness. PLATTER is not in itself an audit or certification tool but is rather designed to complement existing audit and certification tools by providing a framework which will allow new repositories to incorporate the goal of achieving trust into their planning from an early stage. A repository planned using PLATTER will find itself in a strong position when it subsequently comes to apply one of the existing auditing tools to confirm the adequacy of its procedures for maintaining the long term usability of and access to its material.
