Gun Industry Liability: Lawsuits and Legislation

Description: This report discusses gun industry liability issues after the Maryland Court of Appeals announced that it was changing the common law "to hold the manufacturers and marketers of Saturday Night Special handguns strictly liable to innocent persons who suffer gunshot injuries from the criminal use of their products." Kelley v. R.G. Industries, Inc., 497 A.2d 1143, 1159 (Md. 1985).

Federal Advertising Law: An Overview

Description: This report provides a brief overview of federal law with respect to five selected advertising issues: alcohol advertising, tobacco advertising, the Federal Trade Commission Act, advertising by mail, and advertising by telephone. There are numerous federal statutes regulating advertising that do not fit within any of these categories; as random examples, the Food, Drug, and Cosmetic Act requires disclosures in advertisements for prescription drugs ; the Truth in Lending Act governs the advertising of consumer credit ; and a federal criminal statute makes it illegal falsely to convey in an advertisement that a business is connected with a federal agency.

Asia's Reaction to NAFTA

Description: NAFTA raises potential economic and political issues for U.S. relations with Asian countries for whom the agreement presents uncertainties regarding the future of their market opportunities in North America. As countries not associated with a preferential trading arrangement of their own, Asian countries are concerned that a trend toward regional trade agreements may affect the capacity of multilateral institutions to protect their global trading interests. This report examines Asian perceptions of NAFTA in both their economic and political dimensions, how Asian countries may respond in concrete ways to NAFTA, and, assuming that NAFTA gains approval in the U.S. Congress, what steps the United States might take toward facilitating a smooth reception for NAFTA in Asia.

Federal Funding Gaps: A Brief Overview

Description: This report briefly discusses federal funding gaps. The routine activities of most federal agencies are funded annually by one or more of the 13 regular appropriations bills. When action on the regular appropriations bills is delayed, a continuing resolution (CR) is used to provide interim funding. During the past 48 years, CRs have been enacted for all but four fiscal years (FY1953, 1989, 1995, and 1997). For some fiscal years, a series of as many as six CRs have been enacted.

Fiscal Year 1998 Continuing Resolutions

Description: Congress annually considers 13 regular appropriations bills providing funding for agency operations. If any of these bills are not enacted by the start of the fiscal year (October 1), the nonessential activities of the agencies funded in the outstanding bills must cease. In those years in which all 13 bills are not enacted by the deadline, Congress adopts measures continuing funding until the regular bills are enacted. This report discusses these measures, which are referred to as continuing resolutions.

Military Retirement and Veterans' Compensation: Concurrent Receipt Issues

Description: This report describes the history and background of the offset and the legislative history of recent attempts to eliminate or reduce the offset. It delineates and analyzes the arguments for and against eliminating or reducing the offset and allowing concurrent receipt, and addresses the issues of costs, precedents in other Federal programs, purposes of the two programs, and equity issues. Finally, options other than full concurrent receipt are mentioned.
