"Fast Track" Congressional Consideration of Recommendations of the Base Realignment and Closure (BRAC) Commission

Description: The recommendations of the 2005 Base Realignment and Closure (BRAC) Commission will automatically take effect unless, within a stated period after the recommendations are submitted to the House and Senate, Congress adopts a joint resolution of disapproval rejecting them in their entirety. Congressional consideration of this disapproval resolution is not governed by the regular rules of the House and Senate, but by special expedited or “fast track” procedures laid out in statute. This report describes these expedited parliamentary procedures and explains how they differ from the regular legislative processes of Congress.

The Berry Amendment: Requiring Defense Procurement to Come from Domestic Sources

Coast Guard Deepwater Program: Background and Issues for Congress

Description: The Deepwater program is a $24-billion, 25-year acquisition program to replace or modernize 93 Coast Guard ships and 207 Coast Guard aircraft. The Coast Guard’s FY2006 budget requests $966 million for the program. Some Members of Congress have strongly criticized the Deepwater program on several grounds. The House version of H.R. 2360, the FY2006 Department of Homeland Security (DHS) appropriations bill, reduces the FY2006 Deepwater funding request to $500 million; the Senate version reduces it to $905.6 million.

Department of Defense Food Procurement: Background and Status

Description: In an effort to reduce costs, adopt commercial practices, and gain technological advantages, the DOD Food Policy Council directed the Defense Supply Center Philadelphia (DSCP) to establish a common food management system. Under DLA, DSCP is the inventory control point for food, clothing, textiles, medicines, medical equipment, general and industrial supplies and services for the military, their eligible dependents, and other non-DOD customers worldwide; under DSCP, the Subsistence Directorate serves as the operational manager for all food operations. This report will describe the origin, authority, policy, and military food acquisition process.

The Availability of Judicial Review Regarding Military Base Closures and Realignments

Description: The 2005 round of military base realignments and closures (BRAC) is now underway. The Defense Base Closure and Realignment Act of 1990 (Base Closure Act), as amended, establishes mandatory procedures to be followed throughout the BRAC process and identifies criteria to be used in formulating BRAC recommendations. However, judicial review is unlikely to be available to remedy alleged failures to comply with the Base Closure Act’s provisions. This report includes a synopsis of the relevant law regarding the availability of judicial review in this context.
