Defense Cleanup and Environmental Programs: Authorization and Appropriations for FY2001

Description: The Department of Defense operates six environmental programs: cleanup of past contamination at military facilities, acceleration of cleanup at military bases designated for closure, compliance with environmental laws and regulations that apply to ongoing military operations, pollution prevention, natural resource conservation, and environmental technology. In addition to these activities, the Department of Energy is responsible for managing defense nuclear waste and remediating contaminated sites. This report discusses the federal laws that established these programs, describes their scope and purpose, provides a history of appropriations, indicates the President’s budget request for FY2001, examines authorization and appropriations legislation for FY2001, and discusses other relevant legislation considered in the 106th Congress.

Nuclear Cooperation Agreement with Russia: Statutory Procedures for Congressional Consideration and Their Implementation

Description: This report sketches the procedures prescribed by the Atomic Energy Act (AEA) for congressional action in relation to nuclear cooperation agreements, then summarizes legislative proceedings occurring in relation to the proposed agreement with Russia, beginning with its recent submission. It also addresses several questions regarding the implementation and intent of these statutory requirements related to the proposed agreement with the Russian Federation. Special attention is given to the definition of "days of continuous session" and possible implications of this definition depending on whether or not the requisite period ends before the end of the 110th Congress.

Charitable Choice, Faith-Based Initiatives, and TANF

Description: The Senate Finance Committee version of H.R. 7, approved on July 16, 2002, does not contain the “charitable choice” title of the House-passed H.R. 7; nor does it include a compromise “faith-based” provision (from S. 1924 as introduced) that sought to assure equal treatment for nongovernmental providers of almost all federally-funded social services. Remaining in the Senate Finance bill are tax incentives to promote private giving. The Charitable Choice Act of 2001 (Title II of the House bill) would apply its rules, which are significantly different from those in four existing charitable choice laws, to nine new program areas.

The Army Corps of Engineers' Nationwide Permits Program: Issues and Regulatory Developments

Description: Permits issued by the U.S. Army Corps of Engineers authorize various types of development projects in wetlands and other waters of the United States. The Corps' regulatory process involves two types of permits: general permits for actions for private landowners that will likely have a minor effect on wetlands, and individual permits for more significant actions. Interest groups have a number of specific criticisms of the permits. For some time, there has been a stalemate in Congress over legislation related to this issue.

Clean Water Issues in the 105th Congress

Description: For the 105th Congress, reauthorization of the Clean Water Act may be a priority in the second session. The Act was last amended in 1987 and authorizations expired on Sept. 30, 1990. Clean water was a priority for the last two Congresses, but no legislation was enacted. In the 104th Congress, the House passed a comprehensive reauthorization bill, but during House debate and subsequently, controversies arose over whether and how the Act should be made more flexible and less burdensome on regulated entities. Issues likely to be of interest again in the 105th Congress include funding, overall flexibility and regulatory reform of water quality programs, and measures to address polluted runoff from farms and city streets.

Description: On May 3, 2002, the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (the Corps) announced a final rule redefining two key terms, “fill material” and “discharge of fill material,” in regulations that implement Section 404 of the Clean Water Act.
