Since FY2003, DOD has sought broader exemptions that it argues are needed to preserve training capabilities and ensure military readiness. There has been disagreement in Congress over the need for broader exemptions in the absence of data on the overall impact of environmental requirements on training and readiness.

Air Quality Issues and Animal Agriculture: EPA's Air Compliance Agreement

Description: In an effort to collect scientifically credible data regarding the effect of animal agriculture on water resources (specifically animal waste and emissions from animal feeding operations (AFO), the Environmental Protection Agency (EPA) in January 2005 announced the Air Compliance Agreement. The agreement is intended to produce air quality monitoring data on AFO emissions during a two-year study, while at the same time protecting participants through a “safe harbor” from liability under certain … more

Clean Water Act Issues in the 107th Congress

Description: Key water quality issues that may face the 107th Congress include: actions to implement existing provisions of the Clean Water Act (CWA), whether additional steps are necessary to achieve overall goals of the Act, and the appropriate federal role in guiding and paying for clean water activities. Legislative prospects for comprehensively amending the Act have for some time stalled over whether and exactly how to change the law. If clean water issues receive attention in the 107th Congress, consi… more

Clean Water Act Issues in the 108th Congress

Description: In this report several other Clean Water Act issues are likely to receive congressional attention, through oversight hearings and possibly in legislative proposals. Among the topics of interest is whether and how the Administration will revise the current program for restoration of pollution-impaired waters (the Total Maximum Daily Load, or TMDL program), in view of controversy over regulatory changes made during the Clinton Administration and continuing disagreement among states, cities, indus… more

Clean Water Act Issues in the 109th Congress

Description: Congress has recently focused legislative attention on narrow bills to extend or modify selected Clean Water Act (CWA) programs, rather than taking up comprehensive proposals. In the 109th Congress, the Senate Environment and Public Works Committee has approved S. 1400, a bill authorizing $20 billion in federal grants to capitalize state clean water infrastructure loan programs. Also, a House committee has approved bills to reauthorize several Clean Water Act programs: H.R. 624 would provide $1… more

EPA Policies Concerning Integrated Planning and Affordability of Water Infrastructure

Description: This report examines two recent initiatives by the Environmental Protection Agency (EPA) in which the agency works with states to develop and implement new approaches for water quality goals that will be more cost-effective and address the most pressing water infrastructure problems first. The examples include an integrated planning policy and a framework policy for assessing a community's financial capability to meet objectives and requirements of the Clean Water Act (CWA).

Environmental Protection Issues in the 108th Congress

Description: The 108th Congress has acted on a variety of disparate environmental measures; some of these represent proposals or issues that had been under consideration in the 107th Congress and earlier. Clean Air Act Issues in the 107th Congress

Description: Revisions to the air quality standards for ozone and particulates, promulgated by the Environmental Protection Agency in 1997, may also command renewed attention in the 107th Congress. The standards were challenged in the courts, and implementation is currently in limbo, pending resolution of appeals to the Supreme Court. The Court heard oral arguments November 7, 2000, and a decision is expected in spring 2001. The decision is likely to stimulate congressional oversight, and perhaps legislatio… more
