Federal Liability for Flood Damage Related to Army Corps of Engineers Projects

Description: This report examines selected issues of the federal government's liability depending on the theory of the levee failures, and analyzes legal defenses available to the federal government. The report uses flood damage related to Hurricane Katrina as an illustration of these legal issues regarding federal liability, but the general principles in the analysis would apply to flood damage resulting from any such flood control project.

Department of Homeland Security: State and Local Preparedness Issues

Description: The Homeland Security Act of 2002 (P.L. 107-296) makes the new Department of Homeland Security (DHS) responsible for providing assistance to state and local governments to ensure adequate preparedness for all disasters, including terrorist attacks. Several federal entities with functions relating to state and local preparedness, ranging from entire independent agencies to units of agencies and departments, will be transferred to the new department.

The National Flood Insurance Program (NFIP), Reinsurance, and Catastrophe Bonds

Description: This report discusses the use of reinsurance to transfer some of the risk of an insurance policy from the primary insurer to a secondary insurer, and the National Flood Insurance Program's (NFIP) decision to use reinsurance through the issuance of catastrophe bonds (which pay out when a particular type of disaster set out in the bond agreement occurs) by the secondary private insurers.

Emergency Assistance for Agricultural Land Rehabilitation

Description: This report discusses the U.S. Department of Agriculture's (USDA) several permanently authorized programs to help producers recover from natural disasters. Most of these programs offer financial assistance to producers for a loss in the production of crops or livestock.
