Fish and marine mammals are important resources in open ocean and nearshore coastal areas; many federal laws and regulations guide their management. This report discusses a variety of laws and legislation pertaining to this issue.
The Marine Protection, Research, and Sanctuaries Act has two basic aims: to regulate intentional ocean disposal of materials, and to authorize related research. Permit and enforcement provisions of the law are often referred to as the Ocean Dumping Act. The basic provisions of the act have remained virtually unchanged since 1972, when it was enacted to establish a comprehensive waste management system to regulate disposal or dumping of all materials into marine waters that are within U.S. jurisdiction, although a number of new authorities have been added. This report presents a summary of the law.
This report reviews the history and trends of oil spills in the United States, and identifies the legal authorities governing oil spill prevention, response, and cleanup.
Aquaculture — the farming of fish, shellfish, and other aquatic animals and plants in a controlled environment — is expanding rapidly abroad, with more modest advances in the United States. This report discusses the federal laws and regulations that guide the management of resources in open ocean and near-shore coastal areas.
This report considers potential implications for U.S.-China relations. China's actions for asserting and defending its maritime territorial and exclusive economic zone (EEZ) claims in the East China (ECS) and South China Sea (SCS), particularly since late 2013, have heightened concerns among observers that ongoing disputes over these waters and some of the islands within them could lead to a crisis or conflict between China and a neighboring country such as Japan, the Philippines, or Vietnam.
This report focuses on oil spills in U.S. coastal waters. The first section highlights background issues, including oil spill statistics and potential environmental impacts. The second section discusses the legal framework that governs oil spill prevention and response. The third section examines the threat of future oil spills in coastal waters and whether response personnel are prepared to respond to a major spill.
This report presents policy and oversight issues for Congress arising from maritime territorial disputes involving China in the South China Sea (SCS), East China Sea (ECS), and an additional dispute over whether China has a right under international law to regulate U.S. and other foreign military activities in its maritime Exclusive Economic Zone (EEZ).
This report discusses the increasing concern, within the scientific community, that rising levels of carbon dioxide in the atmosphere could detrimentally alter marine ecosystems. The report discusses how ocean acidification happens, its possible outcomes, as well as natural and human responses that could possibly limit or reduce the rate of the process.

The massive Tohoku earthquake and tsunami of March 11, 2011, caused extensive damage in northeastern Japan, including damage to the Fukushima Dai-ichi nuclear power installation, which resulted in the release of radiation. This report discusses concerns about the potential effects of this released radiation on the U.S. marine environment and resources.
The massive Tohoku earthquake and tsunami of March 11, 2011, caused extensive damage in northeastern Japan, including damage to the Fukushima Dai-ichi nuclear power installation, which resulted in the release of radiation. This report discusses concerns which have arisen about the potential effects of this released radiation on the U.S. marine environment and resources.
This report discusses laws related to the protection of marine mammals when using mid-frequency active sonar including the Marine Mammal Protection Act (MMPA), the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Coastal Zone Management Act (CZMA). The report discusses each of the laws generally, and then reviews the litigation surrounding the Navy's compliance with these laws in the context of using the sonar for training purposes off California's coast.
This report describes wave, tidal, and in-stream energy generation technologies — also referred to as hydrokinetic or marine energy. It discusses the recent changes in law aimed to clarify the federal role in ocean wave and renewable energy.

This report provides background information and issues for Congress on the modernization of the Coast Guard's polar icebreaker fleet, which performs a variety of missions supporting U.S. interests in polar regions. The Coast Guard's two heavy polar icebreakers-Polar Star and Polar Sea-have exceeded their intended 30-year service lives, and neither is currently in operational condition.

This report discusses policy and legislation regarding fish and marine mammals. These animals are important resources in open ocean and nearshore coastal areas. Commercial and sport fishing are jointly managed by the federal government and individual states. Many laws and regulations guide the management of these resources by federal agencies.
This report provides information on how Highly Migratory Species (HMS) like tunas, oceanic sharks, sailfishes, swordfishes, bill-fishes, and marlins are managed differently because of their migratory behavior. This includes information on which of these fish belongs to who basing on the jurisdiction on where these species migrate to. Updated April 21, 2000.
Both experience and economic models show that, in the absence of enforceable access or catch restrictions, competition among commercial fishermen results in an expansion of fishing capacity, and resultant fishing effort, beyond the sustainable limits of the fish population being pursued. The spiral of increasing effort and diminishing returns (i.e., rent dissipation) has helped to fuel increases in fish prices that reduce benefits to consumers and processors; has shifted many fish populations toward smaller, younger fish that typically command lower prices; and in many cases has reduced yields far below achievable levels. Congress has considered several approaches to address concerns about overcapitalization and excess capacity in the fishing industry.
On July 29, 1994, the United States signed the Agreement Relating to the Implementation of Part XI of the United Nations Convention on the Law of the Sea of 10 December 1982. This agreement substantially reforms the seabed mining provisions of the 1982 Convention, which the United States found objectionable. In signing the Agreement, President Clinton accepted provisional application of it which enables the United States to participate in the International Seabed Authority (ISA) and its organs and bodies. On November 16, 1994, the U.N. Law of the Sea Convention entered into force without accession by the United States. The treaty document was referred to the Senate Committee on Foreign Relations late in the 103d Congress and awaits committee action in the 104th Congress.
This report summarizes the fact that northern right whale is the most endangered among all the whale species. The National Marine Fisheries Service is taking extra measures to protect these whales from any negative human interactions.
