People Crossing Borders: An Analysis of U.S. Border Protection Policies

Description: This report provides an overview of the current border protection framework and its operationally oriented strategic elements and measures their effectiveness. The report draws on documents from Congress and the Administration, as well as other publications, to pull together an overarching picture of protection at the border. This overview includes a historical background and a definition of what "border protection" means in a contemporary context. Building on this definition, the report provides two theoretical models for border protection approaches based on unilateral and cooperative approaches, followed by an extended analysis of the major elements within the current border protection framework. This analysis also includes discussions of how and why, certain strategic elements notwithstanding, many of the current border-related security policies focus on the physical border rather than conceptualizing the border in broader terms. Lastly, this report offers some policy options--both short-term and long-term--for addressing the effectiveness of current border protection policies.

Persistent Organic Pollutants (POPs): Fact Sheet on Three International Agreements

Description: Persistent organic pollutants (POPs) are chemicals that do not break down easily in the environment, tend to accumulate as they move up the food chain, and may be harmful to people and wildlife. Between 1998 and 2001, the United States signed tow international treaties and one executive agreement to reduce the production and use of POPs and to regulate the trade and disposal of them. This report discusses these treaties in detail, as well as their ratification process and U.S. statutes that are inconsistent with these treaties.

Piracy: A Legal Definition

Description: This report first examines the historical development of the offense of piracy, as defined by Congress and codified in the United States Code. The focus then turns to how contemporary international agreements define piracy. Finally, the report highlights developments in two trials involving charges of piracy in the federal district court in Norfolk, VA, United States v. Said and United States v. Hasan, specifically focusing on how the courts interpreted the definition of piracy under 18 U.S.C. § 1651.

Piracy: A Legal Definition

Description: Pirate attacks in the waters off the Horn of Africa, including those on U.S.-flagged vessels, have brought continued U.S. and international attention to the long-standing problem of piracy in the region. A recent development in one of the piracy trials in Norfolk, VA, has highlighted a potential limitation in the definition of piracy under the United States Code. This report first examines the historical development of the offense of piracy, as defined by Congress and codified in the United States Code. The focus then turns to how contemporary international agreements define piracy. Finally, the report highlights a recent federal district court ruling that the offense of piracy under 18 U.S.C. § 1651 requires a robbery at sea.
