Covert Action and Clandestine Activities of the Intelligence Community: Selected Notification Requirements in Brief

Description: This report discusses the requirements for notifying Congress of covert action and clandestine activities of the intelligence community and activities of the military. These requirements originated from instances in the 1970s when media disclosure of past intelligence abuses underscored reasons for Congress taking a more active role in oversight. Over time, these requirements were written into statute or became custom.

Securing America's Borders: The Role of the Intelligence Community

Description: Maintaining the security of U.S. borders is a fundamental responsibility of the federal government. This report discusses the contribution of intelligence agencies to the border security efforts of the Department of Homeland Security, the Department of Defense, and other federal agencies that work in cooperation with state, local, and tribal law enforcement agencies. Much of the intelligence community's border security-related efforts are classified, however.

Description: With Congress considering a possible change regarding sensitive covert action policy, this memorandum describes the statutory provision authorizing Gang of Eight notifications, reviews the legislative history of the provision, and examine both the impact of such notifications on congressional oversight as well as options that Congress might consider to possibly improve oversight.
