Unauthorized Aliens, Higher Education, In-State Tuition, and Financial Aid: Legal Analysis

The TRIO Programs: A Primer

Description: This report is an introduction to the TRIO programs: the primary federal programs providing support services to disadvantaged students to promote achievement in postsecondary education. The TRIO programs were so named by the 1968 Higher Education Act (HEA) amendments, which consolidated a trio of programs under one title. Federal Student Loans Made Under the Federal Family Education Loan Program and the William D. Ford Federal Direct Loan Program: Terms and Conditions for Borrowers

Description: This report discusses major provisions of federal student loans made available through the William D. Ford Federal Direct Loan (DL) program and previously made through the FFEL program. It focuses on provisions related to borrower eligibility, loan terms and conditions, borrower repayment relief, and loan default and its consequences for borrowers. Unauthorized Alien Students: Issues and "DREAM Act" Legislation

Description: In recent years, multiple bills have been introduced in Congress to provide relief to unauthorized alien students. In most cases, these bills have proposed to repeal the 1996 provision and enable certain unauthorized alien students to adjust to legal permanent resident (LPR) status in the United States. These bills have often been entitled the Development, Relief, and Education for Alien Minors Act, or the DREAM Act. This report discusses the background and debate surrounding "Dream Act" legislation in the 110th and 111th Congress.

Sexual Violence at Institutions of Higher Education

Description: Currently, there are two federal laws that address sexual violence on college campuses: the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act, P.L. 101-542) and Title IX of the Education Amendments of 1972 (Title IX, P.L. 92-318). Following a discussion exploring the prevalence of sexual violence at IHEs, this report provides a detailed policy and legal analysis of these two statutes, as well as a brief description of a third statute related to educational privacy. The report concludes with a summary of the steps that have been taken by Congress and the Administration to address campus sexual violence.

The American Opportunity Tax Credit: Overview, Analysis, and Policy Options

Description: This report provides both an in-depth description of this tax credit and an analysis of its economic impact. This report is organized to first provide an overview of the American Opportunity Tax Credit (AOTC), followed by a legislative history that highlights the evolution of education tax credits from proposals in the 1960s through the recent extension of the AOTC at the end of 2012. This report then analyzes the credit by looking at who claims the credit, the effect education tax credits have on increasing college attendance, and administrative issues with the AOTC. Finally, this report concludes with a brief overview of various policy options, including tax law changes proposed in Chairman Camp's tax reform bill3 and in the President's FY2015 budget request.
