Environmental Regulation and Agriculture

Description: This report discusses the impact of environmental regulation on agriculture. Most environmental regulations, in terms of permitting, inspection, and enforcement, are implemented by state and local governments, often based on federal EPA regulatory guidance. In some cases, agriculture is the direct or primary focus of the regulatory actions. In other cases, agriculture is one of many affected sectors. Traditionally, farm and ranch operations have been exempt or excluded from many environmental regulations.

Description: From Summary: "This report describes and analyzes H.R. 4024 and S. 1961, as reported. The bill share a number of broadly similar provisions-both would direct states or the Environmental Protection Agency (EPA) to establish programs to prevent and respond to releases from chemical storage facilities (H.R. 4024) or tanks (S. 1961) located near drinking water sources-but they take different approaches to doing so; S. 1961 would make programmatic changes by amending the Safe Drinking Water Act (SDWA), while H.R. 4024 would amend the Clean Water Act (CWA)."

EPA Regulations: Too Much, Too Little, or On Track?

Description: This report provides background information on Environmental Protection Agency (EPA) regulatory activity during the Obama Administration to help address these issues. It examines major or controversial regulatory actions taken by or under development at EPA since January 2009, providing details on the regulatory action itself, presenting an estimated timeline for completion of the rule (including identification of related court or statutory deadlines), and, in general, providing EPA's estimates of costs and benefits, where available. The report includes tables that show which rules remain under development, and an appendix that describes major or controversial rules that are now final.

The Wetlands Coverage of the Clean Water Act is Revisited by the Supreme Court: Rapanos v. United States

Description: This report discusses the Supreme Court decision in Rapanos v. United States, which addressed the asserted jurisdiction of the U.S. Army Corps of Engineers and the Environmental Protection Agency (EPA) over wetlands adjacent to "waters of the United States," the problematic phrase used by the Clean Water Act (CWA) to define the geographic scope of the act's wetlands permitting program.

Climate Change Legislation in the 113th Congress

Description: This report focuses on legislative actions--including comprehensive bills with individual climate change titles, sections, or provisions--that explicitly address climate change issues. The provisions in these bills fall into six general categories: carbon price (i.e., tax or fee) on greenhouse (GHG) emissions; other mechanisms intended to encourage mitigation of GHG emissions (e.g., sequestration of emissions); research on climate change-related issues; adaptation activities related to expected climate change impacts; support for international climate change-related activities; and action that limits or prohibits climate change-related authorities, efforts, or considerations.

The Endangered Species Act (ESA) in the 109th Congress: Conflicting Values and Difficult Choices

Description: This report discusses various proposals to amend the Endangered Species Act of 1973 (ESA; P.L. 93-205, 16 U.S.C. §§1531-1543). Major issues include changing the role of science in decision-making, modifying critical habitat (CH) procedures, reducing conflicts with Department of Defense activities, incorporating further protection and incentives for property owners, and increasing protection of listed species, among others.

Air Quality Issues and Animal Agriculture: EPA's Air Compliance Agreement

Description: In an effort to collect scientifically credible data regarding the effect of animal agriculture on water resources (specifically animal waste and emissons from animal feeding operations (AFO), the Environmental Protection Agency (EPA) in January 2005 announced the Air Compliance Agreement. The agreement is intended to produce air quality monitoring data on AFO emissions during a two-year study, while at the same time protecting participants through a “safe harbor” from liability under certain provisions of federal environmental laws. This report discusses the agreement and the perspectives of both its supporters and opponents.
