National Security Letters: Proposals in the 112th Congress

Description: This report reprints the text of the five National Security Letter (NSL) statutes as they now appear and as they appeared prior to amendment by the USA PATRIOT Act (to which form they would be returned under S.1125 and H.R. 1805). NSLs are roughly comparable to administrative subpoenas. Various intelligence agencies use them to demand certain customer information from communications providers, financial institutions, and consumer credit reporting agencies under the Right to Financial Privacy Act, the Fair Credit Reporting Act, the National Security Act, and the Electronic Communications Privacy Act.

Immigration-Related Worksite Enforcement: Performance Measures

Description: In the spring of 2009, the Department of Homeland Security (DHS) issued new guidance on immigration-related worksite enforcement. According to 2010 estimates, there are some 8.0 million unauthorized workers in the U.S. civilian labor force. Enforcement activity by the Department of Labor (DOL) is also relevant to a discussion of federal efforts to curtail unauthorized employment.

Comprehensive Nuclear-Test-Ban Treaty: Background and Current Developments

Description: This report discusses the Comprehensive Nuclear-Test-Ban Treaty (CTBT), which bans all nuclear explosion and was in 1996 adopted by the U.N. General Assembly but rejected by the U.S. Senate in 1997. This report discusses the Obama Administration's stated goal of pursuing U.S. ratification of the CTBT, although the Administration has mainly focused on securing Senate consent to ratification of the New Strategic Arms Reduction Treaty (New START). This report also discusses other nuclear weapons-related issues as well as the long history of nuclear testing.

Military Personnel and Freedom of Religion: Selected Legal Issues

Description: This report provides an overview of the requirements of the First Amendment related to military personnel's religious exercise. It analyzes current constitutional and statutory requirements regarding religious exercise, and provides a framework for how Congress and the courts might consider future issues that arise related to service members' religious exercise. Specifically, the report examines the limitations placed on service members in uniform in the exercise of their religious beliefs. It also examines the role of military chaplains and the legal challenges associated with publicly funding religious personnel. The report analyzes efforts by Congress and the Department of Defense to address the constitutional concerns that are raised by these issues.
