Protecting Classified Information and the Rights of Criminal Defendants: The Classified Information Procedures Act

Description: A criminal prosecution involving classified information may cause tension between the government's interest in protecting classified information and the criminal defendant's right to a constitutionally valid trial. In some cases, a defendant may threaten to disclose classified information in an effort to gain leverage. Concerns about this practice, referred to as "graymail," led the 96th Congress to enact the Classified Information Procedures Act to provide uniform procedures for prosecutions involving classified information.

Protecting the U.S. Perimeter: "Border Searches" Under the Fourth Amendment

Description: This report addresses the scope of the government's authority to search and seize individuals at the border pursuant to the constitutional framework that encompasses the border search exception to the warrant and probable cause requirements of the Fourth Amendment. This report also describes the varying levels of suspicion generally associated with each type of border search as interpreted by the courts. In addition, this report highlights some of the border security recommendations made by the 9/11 Commission and legislative actions taken in the 108th, 109th, and 110th Congresses.

Description: This report first outlines the statutes authorizing certain federal officers to conduct warrantless searches. It then addresses the scope of the government's constitutional authority to search and seize persons and property at the border. It also describes the varying levels of suspicion generally required for each type of border search as interpreted by the courts. Finally, this report lists several bills before the 111th Congress that address border searches. This report does not address interior searches and seizures performed by immigration personnel since they are not traditional "border searches."

Reauthorizing the Office of National Drug Control Policy: Issues for Consideration

Description: This report provides a discussion of the National Drug Control Strategy, the National Drug Control Budget, and the Office of National Drug Control Policy's (ONDCP's) evaluation of the National Drug Control Strategy implementation. It then provides an analysis of selected legislative and oversight issues that Congress may consider when debating the reauthorization of ONDCP. Policymakers may question the status of the war on drugs, whether drug use should be seen as more of a law enforcement issue or a public health issue, and whether drug control resources are more effective when directed toward prevention and treatment or toward law enforcement. Another issue for consideration is whether the National Drug Control Budget--as currently conceived--represents a comprehensive view of federal drug control activities in the United States. Further, Congress may exercise oversight over ONDCP's means of evaluating the nation's federal drug control programs.
