Federal Tort Reform Legislation: Constitutionality and Summaries of Selected Statutes

Description: This report considers the constitutionality of federal tort reform legislation, such as the products liability and medical malpractice reform proposals that have been introduced for the last several Congresses. Tort law at present is almost exclusively state law rather than federal law, although, as noted in the appendix to this report, Congress has enacted a number of tort reform statutes.

Statutory Interpretation: General Principles and Recent Trends

Description: The Supreme Court has expressed an interest "that Congress be able to legislate against a background of clear interpretive rules, so that it may know the effect of the language it adopts." This report identifies and describes some of the more important rules and conventions of interpretation that the Court applies. Although this report focuses primarily on the Court's methodology in construing statutory text, the Court's approach to reliance on legislative history are also briefly described.

The Uniformed and Overseas Citizens Absentee Voting Act: Background and Issues

Description: Members of the military and U.S. citizens who live abroad are eligible to register and vote absentee in federal elections under the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) of 1986. The law was enacted to improve absentee registration and voting for this group of voters and to consolidate existing laws. This report summarizes the UOCAVA and details modifications and improvements to the UOCAVA since its inception, as well as related pieces of legislation.

Immigration Consequences of Criminal Activity

Description: This report discusses the potential immigration consequences of criminal activity. "Criminal activity" generally refers to conduct for which an alien has been found or plead guilty before a court of law, though in limited circumstances consequences may attach to the commission of a crime or admission of acts constituting the essential elements of a crime.

Country-of-Origin Labeling for Foods

Description: The 2002 farm bill required retailers to provide country-of-origin labeling (COOL) for fresh produce, red meats, peanuts, and seafood by September 30, 2004. Congress twice postponed implementation for all bu seafood; COOL now must be implemented by September 30, 2008. This report describes the current status of the COOL issue, as well as the ongoing discussion of additional COOL requirements for other foods and food ingredients as part of the proposed Federal Food, Drug, and Cosmetic Act overhaul.
