Dear Doug,
This letter is a follow-up to the phone conversation you and I had
some time back regarding the upcoming appeal of the 21.06 litigation
(the Homosexual Conduct Clause of the Texas Penal Code) to the United States
Supreme Court. If you recall, you and I discussed the prospects of develop-
ing some sort of public interest story about the issue around the time we
filed our petition for review.
As a follow up to that discussion, I am writing to inform you that
our appeal will be filed the week of January 20, 1986. I thought you might
like to know that so we can begin a more specific discussion what you think
might be appropriate coverage for this news item.
Some suggested ideas we tossed around were: (1) a review of why this
case came about, (2) a biographical review of the plantiff and his reasons
for filing the suit, (3) a legal discourse on the "rightness" or "wrongness"
of such statutes as 21.06, (4) a examination into the "powers-that-be" behind
the appeal of the 1982 Buckmeyer decision that ruled 21.06 unconstitutional, and
(5) a look at how a "typical" family deals with the issue of a gay person in
the home (e.g. plantiff's family).
