Administrative Stay of the RFG requirement. Also, a number of
downstream blending operations have not yet been accounted for
in the EIA's RFG production statistics. Because of the confusion
engulfing the motor gasoline market as other States consider
pulling out of the RFG program, it appears that some refiners have
restrained production until definitive demand patterns develop.
Furthermore, analysts may have initially over estimated the
spillover effects from RFG areas to areas using conventional
gasoline.
Other developments affecting the finished motor gasoline market
include the EPA rejection of a request to suspend the RFG program
in Wisconsin;8 pending requests from Maine and Delaware to
opt-out areas that are currently in the RFG program;9 and, a
number of areas--St. Louis, Missouri, Atlanta, Georgia, Phoenix,
Arizona, and El Paso, Texas--have elected to use ultra-low Reid
vapor pressure summer gasoline rather than RFG.10
Court rulings affecting finished motor gasoline markets are
expected this year. The U.S. Court of Appeals heard arguments
in February 1995 concerning an industry challenge to the EPA'srenewable oxygenate standard (ROS) which requires that
renewable oxygenates comprise a prescribed proportion of the
oxygen content of RFG.t1 Recently, the Venezuelan Government
withdrew its complaint from the General Agreements on Tariffs
and Trade against the EPA's ruling that non-U.S. refiners
manufacture RFG based on the 1990 U.S. statutory refiner
baseline, thereby affecting RFG imports. Venezuela re-filed its
complaint with the World Trade Organization, which may delay
resolution by several months.12
Operators of several methyl-tertiary-butyl-ether (MTBE) plants
have undertaken projects to determine the feasibility of converting
existing MTBE units to produce either MTBE or
ethyl-tertiary-butyl-ether (ETBE), and some have commenced
construction of these projects.13
Distillate Fuel Oil
Despite the warmer winter weather, distillate fuel oil demand
reached 3.6 million barrels per day, the highest level for
