MEDIA BUREAU SEEKS COMMENT ON A PETITION FOR RULEMAKING AND REQUEST
FOR LICENSING FREEZES

CTIA - the Wireless Association and the Rural Cellular Association filed a Petition for
Rulemaking and Request for Licensing Freezes on March 15, 2011, pursuant to Section 1.401 of the
Commission's rules,' requesting that the Commission: (1) revise its rules to prohibit future licensing of
TV broadcast stations on channel 51; (2) implement freezes, effective immediately, on the acceptance,
processing, and grant of applications for new or modified broadcast facilities seeking to operate on
channel 51; and (3) accelerate clearance of channel 51 where incumbent channel 51 broadcasters reach
voluntary agreements to relocate to an alternate channel. We seek comment on this petition.
This proceeding will be treated as "permit but disclose" for purposes of the Commission's ex
parte rules. See generally 47 C.F.R. 1.1200-1.1216. As a result of the permit-but-disclose status of
this proceeding, ex parte presentations will be governed by the procedures set forth in Section 1.1206 of
the Commission's rules applicable to non-restricted proceedings.2
Section 1.405(a) of the Commission's rules provides that statements in support of or in opposition
to a petition for rulemaking "shall be accompanied by proof of service upon the petitioner on or prior to
the date of filing ... ."' Section 1.405(b) of the Commission's rules states that replies to such statements
"shall be accompanied by proof of service upon the party or parties filing the statement or statements to
which the reply is directed ....",4 Given that all comments will be posted to the Commission's Electronic
Comment Filing System, we hereby waive the requirement that parties be served hard copies of the
comments and reply comments in this proceeding, pursuant to Section 1.3 of the Commissions rules.s
