MEMORANDUM OPINION AND ORDER

By the Deputy Chief, Commercial Wireless Division, Wireless TelecommunicationsBureau:
1. On February 13, 1997, Industrial Communications & Electronics, Inc. (Industrial), licensee
of Station WNNP548, filed a petition for reconsideration (Petition) of a decision (Decision) by the
Wireless Telecommunications Bureau's Office of Operation ce er s.2 That decision awarded a finder's
preference against Station WNNP548. For the reasons discussed below, Industrial's petition for
reconsideration is granted, the finder's preference award is set aside, and the license is reinstated.
2. On September 21, 1993, William Cosgrove, a previous finder, filed a finder's preference
request against Station 'WNNP548. Nancy Corcoran (Ms. Corcoran), the finder in the instant case, filed
her finder's preference request against the same station on December 21, 1993. On April 15, 1994, the
Office Operations denied Mr. Cosgrove's finder's request against Station WNNP548. The Office of
Operations found that the station was constructed and operating.
3. However, the Office of Operations awarded a finder's preference against Industrial on
December 4, 1996, for Station WNNP548. In its Petition, Industrial submitted an affidavit from Bob
McGowan, Vice President of Motorola, stating that Motorola operates SMR station KNHD360 at Mt.
Tom in Holyoke, Massachusetts and has shared its central controller with SMR station WNNP548 since
the station was placed in operation in May 1990. This evidence was consistent with that provided in the
previous finder's preference case filed against Station WNNP548 by Mr. Cosgrove (i.e., 93F625).
4. Upon reconsideration of Industrial's submission in the instant case, we find that our decision
