released January 29, 1987 (2 FCC Rcd 553 (1987)), proposed to
reallocate twenty multiple address Power Radio Service frequency
pairs in the 928/952 MHz bands to general private (Part
94) multiple address use. On February 25. 1988, the Commission
adopted a Report and Order (3 FCC Rcd 1564 (1988))
retaining these frequencies for the Power Radio Service until
January 1, 1992, when they will become available to any Part 94
user.
" However, on December 16, 1988, William D. Gamble, Deputy
Associate Administrator of the Office of Spectrum Management
of the NTIA. sent a letter to William R. Torak, Deputy
Chief of the Spectrum Engineering Division of the Commission's
Office of Engineering and Technology, concurring to the
action herein. The letter stated that while the Interdepartment
Radio Advisory Committee strongly supported utilizing the entire
allocation for point-to-point operations, the NTIA believes
that in light of the non-Government requirement for pointto-multipoint
operations, "it is in the national interest to proceed
with the report and order as submitted by the FCC".
If the mutually exclusive applications are all
non-Government, then the Commission shall hold a lottery to
choose a successful applicant. If there are a mixture of Government
and non-Government applications, then a joint lottery
shall be held. In the latter case, the lottery shall determine
whether a Government or non-Government entity shall be assigned
a channel. Depending on whether it is a Government or
non-Government entity, either the NTIA or the Commission,
respectively, shall issue the license.
