NOTICE OF PROPOSED RULE MAKING

By the Chief, Allocations Branch:
1. A petition for rule making has been filed by Starkville
Broadcasting Co.. Inc. ("petitioner") requesting the
substitution of FM Channel 291C2 for Channel 292A at
Starkville, Mississippi. Starkville Broadcasting Co. also
requests modification of its license for Station
WSMU(FM), Starkville, Channel 292A to specify operation
on Channel 291C2.
2. Channel 291C2 can be allocated to Starkville, Mississippi,
in compliance with the minimum distance
separation requirements of Sec. 73.207 of the Commission's
Rules provided a construction permit (BMPH
850712LQ) filed by Station WSTH(FM), Channel 291,
Alexander City, Alabama, to relocate its transmitter and
come into full compliance for the Class C1 standards is
approved by the Commission. At present, the proposal for
Channel 291C2 would be short spaced to the 16 kilometer
buffer zone of Station WSTH(FM). However, if the construction
permit is approved to allow Station WSTH(FM)
to operate as a Class C1 facility, the buffer zone would be
removed and Channel 291C2 could be allocated to Starkville.
We shall propose to modify the license of Station
WSMU(FM), Channel 292A to specify operation on
Channel 291C2 in accordance with Sec. 1.420(g) of the
Rules. However, we shall delay final action on the proposal
pending the licensing of the Alexander City station
as proposed. It will also be necessary to impose a site
restriction 22.3 kilometers (13.9 miles) southeast of Starkville.
The site restriction will prevent a conflict with
Station WHAY(FM), Channel 288A, Aberdeen, Mississippi.
3. In order to provide a wide coverage area station for
the Starkville. Mississippi area, the Commission PROPOSES
TO AMEND the FM Table of Allotments, Sec.
73.202(b) of the Commission's Rules, as follows:
4. The Commission's authority to institute rule making
proceedings, showings required, cut-off procedures, and
filing requirements are contained in the attached Appendix
and are incorporated by reference herein. NOTE: A
showing of continuing interest is required by paragraph 2
of the Appendix before a channel will be allotted.
5. Interested parties may file comments on or before
February 20, 1987 and reply comments on or before
March 9 , 1987, and are advised to read the Appendix for
the proper procedures. Additionally, a copy of such comments
should be served on the petitioners, or their counsel
or consultant, as follows:
