NOTICE OF PROPOSED RULE MAKING

By the Acting Chief, Policy and Rules Division:
262A to Brantley as a first local service. As an alternative
we shall propose to substitute Channel 262A for (unused)
Channel 284A at Andalusia, Alabama, and to substitute
Channel 284C2 for Channel 285A at Crestview, Florida,
and modify the Crestview licensee for Station WAAZ-FM
to specify the Class C2 channel. Pursuant to the recent
amendment to the Commission's Rules, Section 1.420(g),
the modification at Crestview can be implemented without
providing the opportunity for additional expressions
of interest in the allotment at Crestview. See Modification
of FM Broadoast Licenses to Higher Class Adjacent and
Co-Channels, MM Docket No. 85-313, 51 FR 20290, June
4, 1986. The proposals for Andalusia and Brantley, Alabama,
can be made in compliance with the minimum
distance separation requirements. However, the allotment
of Channel 284C2 to Crestview is restricted to one (1)
kilometer (0.6 miles) northeast of the city to avoid short
spacing to Station WIZD(FM) (Channel 281), Atmore,
4. In view of the above, the Commission considers it
appropriate to solicit comments on alternate revisions to
the FM Table of Allotments, Section 73.202(b) of the
Rules, with respect to the communities listed below:
1. The Commission herein considers two separately
filed petitions for rule making. The first, filed by Crestview
Broadcasting Company ("CBC"), licensee of Station
WAAZ-FM, Crestview, Florida, seeks to substitute Channel
284C2 for Channel 285A, and to have its license
modified to specify the new channel. To provide for the
upgrade, CBC has requested that Channel 262A be substituted
for unused Channel 284A at Andalusia, Alabama. '
The second petition was filed by Stewart Marsh and Virgil
Leon Strickland, proposing to substitute Channel 279A
for unused Channel 284A at Andalusia, and allot Channel
262A to Brantley, Alabama, as a first FM service.
2. In support of the proposal, CBC states that a Class
C2 facility at Crestview will enable Station WAAZ-FM to
improve the quality of its signal within its coverage area
as well as provide new service. We are also told by CBC
that Channel 262A at Andalusia can be used at the site
chosen by the two applicants for Channel 284A, and still
meet the spacing requirements. Marsh and Strickland
contend that Channel 279A at Andalusia would likewise
meet the spacing requirements, thus providing an opportunity
for first local service on Channel 262A at
Brantley. However, a staff engineering study indicates that
Channel 279A at Andalusia would be short spaced to the
buffer protection of four pending applications for Class C
Channel 278. 2 These applications should be afforded the
same buffer protection (16 kilometers) as Class C stations
(as well as construction permits) in operation before
March 1, 1984. If a construction permit is granted as a
result of one of the above applications for Channel 278,
the permittee will have an opportunity (until March 1,
1987) to become a full Class facility. However, we shall
nevertheless propose to allot Channel 279A to Andalusia
and give the applicants for Channel 278 an opportunity to
indicate their plans to upgrade to Class C status or to
accept a site restriction (ranging from 2 to 6 kilometers)
in order to eliminate the short spacing. The applicants for
Channel 278 are requested to submit comments in this
proceeding stating their willingness in this regard.
3. We feel that these proposals warrant consideration.
Therefore, we shall propose to substitute Channel 279A
for unused Channel 284A at Andalusia and allot Channel
5. The Commission's authority to institute rule making
proceedings, showings required, cut-off procedures, and
filing requirements are contained in the attached Appendix
and are incorporated by reference herein. NOTE: A
showing of continuing interest is required by paragraph 2
of the Appendix before a channel will be assigned.
6. Interested parties may file comments on or before
February 23, 1987, and reply comments on or before
March 10 , 1987, and are advised to read the Appendix
for the proper procedures. Additionally, a copy of such
comments should be served on the petitioners, or their
counsel or consultant, as follows:
