REPORT AND ORDER

By the Acting Chief, Policy and Rules Division:
1. The Commission has before it for consideration the
Notice of Proposed Rule Making herein, 51 FR 4190,
February 3, 1986, issued in response to a petition filed by
Wayne R. Stenz, d/b/a Westwind Radio Company
("petitioner"), proposing the allotment of Channel 299A
to Twentynine Palms, California, as that community's
second local FM broadcast service. Supporting comments
were filed by petitioner reiterating his intention to apply
for the channel, if allotted. No other comments were
2. We believe the public interest would be served by
allotting Channel 299A to Twentynine Palms, California,
since it could provide a second local FM service to the
community for diversity of programming and viewpoints.
3. As indicated in the Notice, Channel 299A can be
allotted to Twentynine Palms consistent with the minimum
spacing requirements of Section 73.207(b) of the
Commission's Rules. Additionally, since the proposed allotment
is within 320 kilometers (199 miles) of the common
U.S.-Mexico border, concurrence of the Mexican
government was obtained.
4. Accordingly, pursuant to the authority contained in
Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the
Communications Act of 1934, as amended, and Sections
0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS
ORDERED, That effective February 9, 1987, the FM
Table of Allotments, Section 73.202(b) of the Commission's
Rules, IS AMENDED with respect to the community
listed below, as follows:
