Is There Justice in Mercy? the Retributive Philosophies of Executive Clemency

Description: Executive clemency is assumed to be a mechanism to correct miscarriages of justice brought about by the criminal justice system, yet little empirical research exists to confirm this assumption. This research study examined the types of rationales cited in 799 cases of executive clemency from six states from 2005 to 2012. Rationales based upon retributive philosophies, in which a miscarriage of justice was cited, were further analyzed. This analysis revealed that only seven percent of all clemency decisions from the examined states cited retributive rationales. Of the fifty-six grants of clemency that cited retributive rationales, most were granted in the forms of pardons. The analysis indicated that executive clemency is utilized as a mechanism to correct injustices, specifically in cases of innocence. This study concludes with a discussion of policy implications and the reliance on executive clemency as a fail-safe to the criminal justice system.

Description: The issue of alternative certification teacher training has greatly affected art education over three decades. As a result of training through alternative certification, many art educators enter the profession unprepared and unable to cope with the realities of teaching. This study attempts to understand and represent the experiences and struggles of four alternatively certified art teachers, including myself. By reading these stories, others within the education community can empathize with and provide support for struggling novice teachers. This creative thesis uses a graphic novel format to represent participants' stories. By combining text and imagery, the graphic novel format provides different meanings, interpretations, and insights into the teachers' lives. This medium offered a unique and rich perspective on the stories of what it is like being an alternatively certified art teacher.

Description: In the world of networked system, average consensus is an important dimension of co-ordinate control and cooperation. Since the communication medium is digital, real value cannot be transmitted and we need to perform quantization before data transmission. But for the quantization, error is introduced in exact value and initial average is lost. Based on this limitation, my 16 bit quantization method (sending MSB in 1-4 cycle and MSB+LSB in 5th cycle) reduces error significantly and preserves initial average. Besides, it works on all types of graphs (star, complete, ring, random geometric graph). My other algorithm, distributing averaging algorithm (PQDA) with probabilistic quantization also works on random geometric graph, star, ring and slow co-herency graph. It shows significant reduced error and attain strict consensus.

Description: Members of Generation Y in the training and development industry will be required to assume leadership roles as Baby Boomers retire, yet little empirical research exists regarding how best to prepare them for leadership. The purpose of this study was to examine differences in leader developmental readiness between generational cohorts in the training industry, specifically Baby Boomers, Generation X, and Generation Y. Leader developmental readiness provided a definition of developmental readiness for leaders using the five constructs (learning goal orientation, developmental efficacy, self-awareness, leader complexity, and metacognitive ability). A volunteer sample was compiled from members of the ASTD National LinkedIN group (n = 636). Results were analyzed using structured means analysis with maximum likelihood (ML) estimation. Generational cohorts demonstrated differences in leader developmental readiness. Baby Boomers indicated statistically and practically higher metacognitive ability and developmental efficacy than Generation Y. Results demonstrated statistically and practically higher leader complexity in Generation Y and both Generation X and Baby Boomers. Description: In this study, a novel method based on biotinylated antibodies and streptavidin coated magnetic beads was used to separate the thrombocyte subpopulations from zebrafish whole blood. DiI-C18, a lipophilic dye, labels only young thrombocytes when used at low concentrations. Commercially available biotinylated anti-Cy3 antibody was used to label the chromophore of DiI-C18 on the young thrombocytes and streptavidin coated magnetic beads were added subsequently, to separate young thrombocytes. The remaining blood cells were probed with custom-made biotinylated anti-GPIIb antibody and streptavidin magnetic beads to separate them from other cells. Further, thrombocytes are equivalents of mammalian platelets. Platelets play a crucial role in thrombus formation. The G-protein coupled receptors (GPCRs) present on the platelet surface are involved during platelet activation and aggregation processes. So, thrombocytes were studied for the presence of GPCRs. The GPCR mRNA transcripts expressed in the young and mature thrombocytes were subjected to densitometry analysis and pixel intensities of the bands were compared using one way ANOVA. Description: TransFantasies is an interdisciplinary composition for Baroque flute (flauto traverso), computer music, and dance. A crucial component of the work is an interactive hardware and software environment that provides the opportunity for the players to shape aspects of the work during the performance. This essay discusses the influences that inspired the work and presents an in-depth analysis of notable elements of the composition. Primary issues include compositional models for gesture-based composition, historical performance practices, interactivity, and relationships between music and dance. The final component of the essay details the software component designed to create the composition. It also discusses music technology in current practice and its role in this particular work. At its core, TransFantasies is concerned with those moments where computer-influenced decisions and human behaviors collide.

Are the intangible qualities of territory more salient to a given population than other factors? Are territorially based terrorist groups more durable than their ideologically or religiously motivated cohorts? Description: High-quality early childhood education and care (ECEC) are linked to positive developmental outcomes for children. Systems have been created to define, measure and promote high-quality ECEC. National accreditation status is deemed the gold standard of a high-quality program, yet many centers are unable to achieve this without assistance. With the help of Accreditation Facilitation Projects (AFPs), many low-income centers are able to achieve accreditation. Centers collaborating with an AFP reap many benefits including financial support, ongoing training and mentoring, and guidance through the accreditation process. AFPs invest greatly in the centers they collaborate with and the longer the center takes to achieve accreditation, the more resources an AFP must expend. The purposes of this study were to understand if the educational level of center director, the total enrollment of a center, or the percentage of children receiving government subsidies could predict the time it takes for a center to complete the accreditation process while receiving assistance from an AFP, and to determine if there are differences in attitudes about program accreditation between center directors and early learning specialists who serve as accreditation mentors to the directors. Description: Many freshwater mussels are imperiled, due to a number of interrelated factors such as habitat alteration, degradation of water quality, and impoundments. The Golden Orb mussel (Quadrula aurea, I. Lea, 1859) is endemic to the state of Texas and is currently a candidate for the endangered species list, as the number of known populations has been declining in recent years. Little is currently known about Q. aurea aside from basic distribution data. This study is focused on evaluating a combination of macro-habitat and micro-habitat variables to determine their influence on the distribution and density of this species. Macro-habitat variables, including dominant land cover, surface geology, and soil erodibility factor, did not have a significant relationship with mussel distributions. The best model of micro-habitat variables that impacts the Q. aurea distributions is comprised of relative substrate stability (RSS) at moderate flows and current velocity at low flows. For all mussel species in this study, current velocity at low flows is the primary variable that influences distribution. Q. aurea are associated with habitats where larger sediment particles (large gravel and cobble) help to stabilize the substrate in areas with higher current velocities. Description: SiC has become an attractive wide bandgap semiconductor due to its unique physical and electronic properties and is widely used in high temperature, high frequency, high power and radiation resistant applications. SiC has been used as an alternative to Si in harsh environments such as in the oil industry, nuclear power systems, aeronautical, and space applications. SiC is also known for its polytypism and among them 3C-SiC, 4H-SiC and 6H-SiC are the most common polytypes used for research purposes. Among these polytypes 4H-SiC is gaining importance due to its easy commercial availability with a large bandgap of 3.26 eV at room temperature. Controlled creation of defects in materials is an approach to modify the electronic properties in a way that new functionality may result. SiC is a promising candidate for defect-induced magnetism on which spintronic devices could be developed. The defects considered are of room temperature stable vacancy types, eliminating the need for magnetic impurities, which easily diffuse at room temperature. Description: How do the content and writing style of people who drink alcohol beverages stand out from non-drinkers? How much information can we learn about a person's alcohol consumption behavior by reading text that they have authored? This thesis attempts to extend the methods deployed in authorship attribution and authorship profiling research into the domain of automatically identifying the human action of drinking alcohol beverages. I examine how a psycholinguistics dictionary (the Linguistics Inquiry and Word Count lexicon, developed by James Pennebaker), together with Kenneth Burke's concept of words as symbols of human action, and James Wertsch's concept of mediated action provide a framework for analyzing meaningful data patterns from the content of blogs written by consumers of alcohol beverages. The contributions of this thesis to the research field are twofold. First, I show that it is possible to automatically identify blog posts that have content related to the consumption of alcohol beverages. And second, I provide a framework and tools to model human behavior through text analysis of blog data.

Description: A conventional RF power amplifier will convert the low powered radio frequency signals into high powered signals. Along with the expected ability to increase the communication distance, data transfer rates, RF power amplifiers also have many applications which include military radar system, whether forecasting, etc. The main objective of any power amplifier research is to increase the efficiency while maintaining linearity and broadening the frequency of operation. The main motivation for the renewed interest in PA technology comes from the technical challenges and the economics of modern digital communication systems. Modern communications require high linear power amplifiers and in order to reduce the complete system cost, it is necessary to have a single broadband power amplifier, which can amplify multiple carriers. The improvement in the efficiency of the power amplifier increases the battery life and also reduces the cooling requirements for the same output power. In this thesis, I aim to design and build a wideband class J power amplifier suitable for modern communications. For wideband operation of the GaN technology PA, a bandwidth extension design method is studied and implemented. The simulation results are proved to have a good argument with the theoretical calculations.

Description: Since the passing of No Child Left Behind Act in 2001, the United States' secondary education system has undergone significant changes. In this study, I discuss the ways in which the law has encouraged the normalization of standardized testing and aim to answer two primary research questions. RQ1: What do college students and their instructors identify as the key challenges that arise as students educated under NCLB begin college coursework, and how does each group address these challenges? RQ2: What strategies do the actors and spect-actors in a Forum Theatre production arrive at for addressing the challenges faced by college instructors and their students who have completed their secondary education under No Child Left Behind? To answer the initial research question, I conducted focus group interviews with instructors and students at the University of North Texas to understand the challenges each faces in the classroom. To answer the second research question, I compiled narratives from the focus group interviews along with other materials into a performance script that concluded with scenarios based in Augusto Boal's Forum Theatre techniques. Description: Mechanics of bone is widely studied and researched, mainly for the study of fracture. This has been done mostly on a macro scale. In this work hierarchical nature of bone has been explored to investigate bone mechanics in more detail. Flexural test were done to classify the bones according to their strength and deflection. Raman spectroscopy analysis was done to map the mineralization, collagen crosslinking changes across the thickness of the bone. Nanoindentation was done to map indentation hardness and indentation modulus across femoral cortex of the bone. The results indicate that the composition of the bone changes across the thickness of the femoral cortex. The hypothesis is confirmed as increase in mineralization, carbonate to phosphate ratio and collagen crosslinking shows the effect as increased indentation hardness and modulus and decreased deflection.

Description: A foreign country's positive or negative image in the U.S. media can influence public attitudes toward that country. The way U.S. media covers sex crimes from countries like India and Pakistan has a direct effect on the global image of these countries. This qualitative content analysis examined the coverage of two rape victims, Jyoti Singh Pandey and Mukhtar Mai in two mainstream U.S. newspapers, the New York Times and the Washington Post. Frames identified in the study include cultural differences, nationality and male patriarchy. The results revealed that while U.S. media was sensitive to both victims, Indian culture was portrayed in a favorable light than Pakistani culture. This study recommends that reporters and newsrooms need to be sensitive in reporting foreign cultures and refrain from perpetuating cultural stereotypes through reporting. The study also recommends developing training and understanding methodology when covering sex crimes so that journalists are aware of the rape myths and narratives that trap them into unfair coverage.

Description: This study examined the bias and precision of four residualized variable validity estimates (C0, C1, C2, C3) across a number of study conditions. Validity estimates that considered measurement error, correlations among error scores, and correlations between error scores and true scores (C3) performed the best, yielding no estimates that were practically significantly different than their respective population parameters, across study conditions. Validity estimates that considered measurement error and correlations among error scores (C2) did a good job in yielding unbiased, valid, and precise results. Only in a select number of study conditions were C2 estimates unable to be computed or produced results that had sufficient variance to affect interpretation of results. Validity estimates based on observed scores (C0) fared well in producing valid, precise, and unbiased results. Validity estimates based on observed scores that were only corrected for measurement error (C1) performed the worst. Not only did they not reliably produce estimates even when the level of modeled correlated error was low, C1 produced values higher than the theoretical limit of 1.0 across a number of study conditions. Estimates based on C1 also produced the greatest number of conditions that were practically significantly different than their population parameters.

Description: Conservation biologists are increasingly using phylogenetics as a tool to understand evolutionary relationships and taxonomic classification. The taxonomy of North American prairie grouse (sharp-tailed grouse, T. phasianellus; lesser prairie-chicken, T. pallidicinctus; greater prairie-chicken, T. cupido; including multiple subspecies) has been designated based on physical characteristics, geography, and behavior. However, previous studies have been inconclusive in determining the evolutionary history of prairie grouse based on genetic data. Therefore, additional research investigating the evolutionary history of prairie grouse is warranted. In this study, ten loci (including mitochondrial, autosomal, and Z-linked markers) were sequenced across multiple populations of prairie grouse, and both traditional and coalescent-based phylogenetic analyses were used to address the evolutionary history of this genus. Results from this study indicate that North American prairie grouse diverged in the last 200,000 years, with species-level taxa forming well-supported monophyletic clades in species tree analyses. With these results, managers of the critically endangered Attwater's prairie-chicken (T. c. attwateri) can better evaluate whether outcrossing Attwater's with greater prairie-chickens would be a viable management tool for Attwater's conservation.

Description: We prove the existence of a one-parameter family of solutions of the porous medium equation, a nonlinear heat equation. In our work, with space dimension 3, the interface is a half line whose end point advances at constant speed. We prove, by using maximum principle, that the solutions are stable under a suitable class of perturbations. We discuss the relevance of our solutions, when restricted to two dimensions, to gravity driven flows of thin films. Here we extend the results of J. Iaia and S. Betelu in the paper "Solutions of the porous medium equation with degenerate interfaces" to a higher dimension.

Description: Oxygen availability is critical for survival for most organisms. The nematode, C. elegans, has been useful for studying genetic regulation of anoxia tolerance due to the oxygen deprivation response mechanisms shared with other metazoans. Studies examining long-term anoxia (72h, LTA) tolerance have only been conducted at adult day 1. To investigate the effect of aging on anoxia tolerance wild-type and mutant strains were exposed to LTA between adult day 1 and day 9. Wild-type isolates and daf-16(mu86) (FOXO transcription factor regulated by insulin-signaling) and aak-2(gt33) (catalytic subunit of AMP-activated protein kinase) strains were anoxia sensitive at day 1 and displayed increased LTA tolerance with aging correlated with reproductive senescence followed by a decline in survivorhsip through day 9. The daf-2(e1370) (insulin receptor homologue of C. elegans), glp-1(e2141) (a lin-12/Notch receptor) and fog-2(q71) (required for spermatogenesis) strains were LTA-tolerant through day 5. I conclude that aging influences LTA-tolerance in a strain- and age-dependent manner. In addition to being LTA-tolerant the daf-2(e1370) and glp-1(e2141) strains have a longevity phenotype that is suppressed by loss of kri-1 or daf-12. While loss of kri-1 did not suppress the LTA-tolerant phenotype of glp-1(e2141) at day 1 the portion of impaired survivors increased at day 3 ...

One of the most common criticisms of leadership training is the tendency to focus on teaching theory but not on applying theory into practice, that is, transfer of learning. Research usually ends at the point of identifying, describing, or measuring factors that influence transfer. Ongoing research must identify what constructs in the transfer of learning process should be effectively changed or managed. Description: This case study addressed the problem of implementing response to intervention (RTI) in general secondary education. To investigate this problem, one north Texas school's RTI implementation was examined using the theoretical framework of the concerns-based adoption model (CBAM) and defining RTI as the innovation. RTI-related practices were studied for 10 secondary teachers, two from each core subject (i.e., mathematics, English language arts, science, and social studies) and the fine arts who had been implementing RTI for several years. Data regarding participants' stages of concern about and levels of use of RTI were collected across three time intervals using the three diagnostic instruments of CBAM (i.e., Stages of Concern Questionnaire, Levels of Use interviews, and Innovation Configuration Checklist matrix), behavioral observations during instruction and RTI meetings, and structured exit interviews of participants. Overall, findings indicated that the secondary teachers were at similar stages of concern and levels of use of RTI. Teachers' RTI concerns scores remained highest in the Self phase and lowest in the Impact phase of concern at all three intervals of data collection. Description: Computational modeling is of fundamental significance in mapping possible disease spread, and designing strategies for its mitigation. Conventional contact networks implement the simulation of interactions as random occurrences, presenting public health bodies with a difficult trade off between a realistic model granularity and robust design of intervention strategies. Recently, researchers have been investigating the use of agent-based models (ABMs) to embrace the complexity of real world interactions. At the same time, theoretical approaches provide epidemiologists with general optimization models in which demographics are intrinsically simplified. The emerging study of affiliation networks and co-affiliation networks provide an alternative to such trade off. Co-affiliation networks maintain the realism innate to ABMs while reducing the complexity of contact networks into distinctively smaller k-partite graphs, were each partition represent a dimension of the social model. This dissertation studies the optimization of intervention strategies for infectious diseases, mainly distributed in school systems. First, concepts of synthetic populations and affiliation networks are extended to propose a modified algorithm for the synthetic reconstruction of populations. Effects of a Prototypical Training Program on the Implementation of Systematic Observational Data Collection on Iep Objectives for the Core Deficits of Autism Spectrum Disorders

Description: Legal mandates and best practice recommendations for the education of students with autism spectrum disorders (ASD) emphasize the importance of systematic, ongoing observational data collection in order to monitor progress and demonstrate accountability. The absence of such documentation in decision-making on instructional objectives indicates a weakness in bridging the research-to-practice gap in special education. Utilizing a multiple baseline design across participants, the current study evaluated the effects of a prototypical teacher training program (i.e., workshop, checklist, in-classroom training with feedback, and maintenance with a thinned schedule of feedback) on the frequency of data collection on core deficits of ASD and the use of data-based decision-making. Results indicate increases in daily mean frequency of data collection following intervention. Maintenance and generalization indicates variable responding across participants. Effect size (Cohen's d) indicates a large, clinically significant effect of the training program. Results are discussed in relation to training models, maintenance, and future research.

Examination of the Relationship Between Glucuronic Acid and Vascular Damage in Rats

Description: The goal of this experiment was to examine the role of glucuronic acid in the development of vascular damage in the kidneys and retinas of diabetic individuals. Glucuronic acid was provided to rats in their water at various concentrations in order to increase plasma levels of the compound. Kidneys and retinas were excised and compared to control specimens using microscopy to determine the effect of elevated blood glucuronic acid levels on the occurrence of microaneurysms in renal capillary networks. No differences were seen between the treatment and control groups. Further study needs to be conducted to determine a more suitable time frame for this experiment.
