Countering Terrorism in East Africa: The U.S. Response

The report does not address covert or clandestine operations to collect intelligence or capture or eliminate terrorist targets in the region.

Description: Pirate attacks in the waters off the Horn of Africa, including those on U.S.-flagged vessels, have brought continued U.S. and international attention to the long-standing problem of piracy in the region. A recent development in one of the piracy trials in Norfolk, VA, has highlighted a potential limitation in the definition of piracy under the United States Code. This report first examines the historical development of the offense of piracy, as defined by Congress and codified in the United States Code. The focus then turns to how contemporary international agreements define piracy. Finally, the report highlights a recent federal district court ruling that the offense of piracy under 18 U.S.C. ยง 1651 requires a robbery at sea.

Description: When civil unrest, violence, or natural disasters erupt in spots around the world, concerns arise over the safety of foreign nationals residing in the United States who are from these troubled places. Provisions exist in the Immigration and Nationality Act (INA) to offer temporary protected status (TPS) or relief from removal under specified circumstances. A foreign national who is granted TPS receives a registration document and an employment authorization for the duration of TPS. The United States currently provides TPS or deferred enforced departure (DED) to over 300,000 foreign nationals from a total of eight countries: El Salvador, Haiti, Honduras, Nicaragua, Somalia, Sudan, and most recently Southern Sudan and Syria.
