On July 31, 2003, the Senate, facing obstacles to passage of its comprehensive energy bill (S. 14), substituted the energy legislation the Senate had passed in the 107th Congress. It is in conference, now as H.R. 6, in the 108th Congress. The Senate bill would require the Secretary of Transportation to issue, not later than 15 months after enactment, “newregulations setting forth increased fuel economy standards” reflecting “maximum feasible fuel economy levels” consistent with factors set out in the original legislation authorizing the corporate average fuel economy [CAFE] standards – the Energy Policy and Conservation Act (EPCA, P.L. 94-163).

The recent change in the leadership in the Senate affects the prospects in the 107th Congress for comprehensive legislation that would mandate increased use of risk analysis by the U.S. Environmental Protection Agency (EPA). No comprehensive risk legislation has been proposed in the 107th Congress, although "unbiased" risk analysis would be required by H.R. 324, a bill to amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (i.e., Superfund).

In response to the foreign challenge in the global marketplace, the United States Congress has explored ways to stimulate technological advancement in the private sector. The government has supported various efforts to promote cooperative research and development activities among industry, universities, and the federal R&D establishment. Among the issues before Congress are whether joint ventures contribute to industrial competitiveness and what role, if any, the government has in facilitating such agreements. Collaborative ventures are intended to accommodate the strengths and responsibilities of all sectors involved innovation and technology development. Given the increased popularity of cooperative programs, questions might be raised as to whether they are meeting expectations. These include questions about the emphasis on collaborative ventures in research rather than in technology development; cooperative manufacturing; defense vs. civilian support; and access by foreign companies.
