Description: This report provides a summary of contested election cases from the 73rd Congress through the 109th Congress, 1933 to 2005. The descriptions primarily provide information concerning the nature of the action and the disposition of the case. The summary is limited to only those cases that were considered by the House of Representatives; cases decided at the state level are beyond the scope of this report.

Palestinian Elections

Description: Fair and transparent elections are seen by experts and policymakers as a necessary step in Palestinian democratization and for the peace process. In 2002, the Palestinian Authority (PA), under increasing internal and external pressure, announced a so-called “100-Day Reform Plan” for institutional reform and elections in order to rejuvenate PA leadership. The 2006 legislative elections were the final and perhaps most critical test for Palestinian democratic institutions.

Counting Electoral Votes: An Overview of Procedures at the Joint Session, Including Objections by Members of Congress

Description: This report describes the steps which precede the joint session and the procedures set in the Constitution and statute by which the House and Senate jointly certify the results of the electoral vote. It also discusses the procedures set in law governing challenges to the validity of an electoral vote, and makes reference to the procedures followed during the joint session in 2005 by which the election of George W. Election of the President and Vice President by Congress: Contingent Election

Description: The 12th Amendment to the Constitution requires that candidates for President and Vice President receive a majority of electoral votes (currently 270 or more of a total of 538) to be elected. If no candidate receives a majority, the President is elected by the House of Representatives, and the Vice President is elected by the Senate. This process is referred to as contingent election and is the topic of discussion in this report.

House and Senate Vacancies: How Are They Filled?

Description: This report discusses how vacancies in Congress are filled when a Senator or Representative dies, resigns, declines to serve, or is expelled or excluded from either house. The Constitution requires that vacancies in both houses be filled by special election, but in the case of the Senate, it empowers state legislatures to provide for temporary appointments by the state governor until special elections can be scheduled.
