This report examines various legal issues raised by Federal and State laws restricting foreign ownership in U. S. property. The report examines the constitutional barriers to Federal and State laws restricting such ownership, and the possible constitutional predicates for Federal legislation regulating foreign ownership of property in the united States. The impact of treaties to which the United States is a party on both Federal and State restrictions on the rights of foreign persons to own U.S. property is also discussed.
Foreign Investment in U.S. Industry
Although the total amount of foreign direct investment (FDI) in the U.S. is small relative to U.S. direct investment abroad, it is growing rapidly and may have a large effect on some industries and geographic areas of the U.S. The two main issues raised by FDI in the U.S. are first, shall Congress require more extensive data collection efforts than are already underway, and second, should laws be enacted to limit foreign direct investment in the U.S. These two issues turn in substantial measure on whether the benefits of additional data collection and/or restrictions on FDI in the U.S. exceed the costs. This report discusses the legislative history of the issue, the magnitude and distribution of FDI in the U.S., the existing data collection efforts, the potential implications for the U.S., the motivations for FDI in the U.S., and U.S. policy regarding FDI.

The 99th Congress has before it several proposals to authorize additional U.S. contributions to multilateral development banks. These include potential subscriptions or contributions to the International Bank for Reconstruction and Development (IBRD), the International Finance Corporation (IFC), the African Development Fund (AFDF), and the special African aid facility of the International Development Association (IDA). There is no legislation now before Congress to authorize new contributions to the International Monetary Fund (IMF), the regular budget of the IDA, or any of the other regional development banks. These have been dealt with in previous years. This paper provides some background on the World Bank and a summary of the pending legislation.

Exchange Rates: The Dollar in International Markets
Mainstream economic theory suggests that U.S. budget deficit was the main cause of the dollar appreciation between 1980 and early 1985. The high budget deficit forced the U.S. Government to compete against the private sector for available savings, raising interest rates in the United States. In response, net capital inflows to the United States increased, the demand for dollars on the foreign exchange market went up, and the dollar appreciated. Restrictive budgets and loose monetary policies abroad, both of which kept interest rates low abroad, also contributed to the dollar’s appreciation on over this period.

A Reappraisal of Foreign Investment Policy
The rise of the multinational corporation and the increased flow of capital across national borders have raised anew the question of how to treat foreign direct investment, both inward and outward. The U.S. government and, increasingly, other governments advocate that, with some exceptions, economic policies should be neutral in the treatment of investment, foreign and domestic, inward and outward. This report discusses the changing view of foreign investment, both nationally and internationally.
International Financial Institutions and Environment: Multilateral Development Banks and the Global Environment Facility
The World Bank and other multilateral development banks (MDB) have come under increasing pressure to assess the environmental impacts of bank-sponsored projects. The U.S. Congress has required that U.S. participation be based on policies that encourage the banks to raise the priority of environmental protection in their operations and to address environmental impacts; however, major issues continue to revolve around the effectiveness of all the MDBs in promoting environmentally sustainable development. Additionally, increasing concern over global environmental problems led to the creation in 1990 of a new multilateral fund -- the Global Environment Facility (GEF) -- to fund environmental projects of global concern that were generally not being funded by the MDBs. The pilot phase of the GEF ended in December 1993, and participants are currently in the process of determining how, or if, it should function as a permanent entity.
The Yen/Dollar Exchange Rate
The dollar declined abruptly in value against the yen in the second quarter of 1994, spurring the central banks of seventeen nations to coordinate a series of intervention efforts in the world's currency trading markets. In addition, the dollar's decline sparked discussions of the possible policy moves the United States and other nations might take to stem the fluctuations in the value of the dollar. Economic theory and empirical evidence indicate that the underlying movement of the exchange rate is tied to the long-term, macroeconomic movements of the economy, or to the combined movements of the economies of different countries, such as the United States and Japan. These macroeconomic factors account for at least half of the overall movement of exchange rates.
Japanese and U.S. Economic Involvement in Asia and the Pacific: Comparative Data and Analysis
In a world in which economic and trade performance are fast gaining acceptance as important components of national power and well being, Congress has become increasingly interested in the comparative success of U.S. business in the vast, rapidly growing Asia-Pacific region. For the most part, Congress has tended to view Japan as the main competitor of the United States in Asian markets and the standard against which U.S. success is measured. The stakes for the United States are considerable. Exclusive of Japan, the Asia-Pacific region accounted for $ 92 billion in U.S. exports in 1993 and $ 138 billion in imports, or about 20 percent of total U.S. exports and 24 percent of U.S. global imports. A number of projections indicate that Asia will account for the largest share of world trade growth in the next decade. Japan's growing economic presence has been accompanied by a relative increase in its political influence vis-a-vis that of the United States, a factor of considerable long term significance for U.S. interests, and it would appear the availability of alternative Asian markets has strengthened Japan's resistance to U.S. trade demands.
Foreign Direct Investment in the U.S.: Staging a Comeback?
After four years of decline, foreign direct investment in the United States showed sharp gains in 1993 and 1994. Japan remained the largest foreign direct investor in the U.S. economy in 1993, despite a sharp slow down in investments by Japanese firms compared with British firms, the second largest direct investors. The overall foreign direct investment position in U.S. businessesand real estate - or the accumulated book value of all foreign investments - increased by $20 billion in 1993, nearly three times faster than the amount recorded in 1992. Preliminary data indicate that foreigners' investments could surpass $30 billion in 1994. Economists generally believe that foreign direct investment yields positive net benefits to both the recipient and the investing countries. For some American firms, foreign investments have been especially beneficial, because they supplied the firms with funds during times when many U.S. commercial banks were unwilling to finance them.

Japanese Trade Balance and Exchange Rate: Seeing Through the Numbers

The Daiwa Bank Problems: Background and Policy Issues
On November 2, 1995, U.S. banking authorities ordered the Daiwa Bank to close its banking operations in the United States, and a 24-count criminal indictment was issued against it. These actions stem from the bank's admission that Toshihide Iguchi, a rogue trader at its New York branch office, had incurred $1.1 billion in losses over eleven years from trading U.S. Treasury securities and that Daiwa managers had "directed that those losses be concealed" from U.S. regulators.
The Federal Reserve's Arrangement for Emergency Loans to Japanese Banks
The U.S. Federal Reserve reportedly has an arrangement with the Bank of Japan to provide emergency loans to Japanese banks operating overseas in exchange for U.S. Treasury securities. The collateralized loans would be extended on short notice for banks facing emergency liquidity needs. The purpose of the arrangement is to forestall the possible sale by Japanese banks of large amounts of U.S. Government securities (thereby raising U.S. interest rates) and to boost confidence in Japan's financial system. The loans would not risk U.S. taxpayers' funds. The Chairmen of both House and Senate Banking Committees have made statements about the arrangement, thus making it a matter oflegislative interest.

In February 1997, the Clinton Administration submitted the second of five annual reports on the Administration's Comprehensive Trade and Development Policy for Africa as required by section 134 of the Uruguay Round Agreements Act (House Document 103-3415, Vol. 1.). On April 24, 1997, members of the African Trade and Investment Caucus introduced a bill, H.R. 1432, on U.S.-Africa trade and investment issues. In his State of the Union address in January 1998, President Clinton called on Congress to pass the trade legislation.

Outer Continental Shelf: Oil and Gas Leasing and Revenue
The Outer Continental Shelf (OCS) was the source of $18 billion of oil and natural gas during 1998. This amounted to 25% of the nation's natural gas production and nearly 20% of the nation's crude oil. Nearly all of this output comes from the Central and Western Gulf of Mexico, where supporting infrastructure is already in place and there is little environmental opposition. Except for one sale in Alaska, no leases have been auctioned since 1991 in any other OCS region. The deep waters off Alabama, Louisiana, and Texas are the current focus of producer interest in the OCS.

The African Development Bank Group, including the Bank itself (AfDB) and its "soft-loan" affiliate, the African Development Fund (AfDF), is a development finance institution based in Abidjan, Côte d'Ivoire. The Bank has 53 African members, as well as 24 non-regional members, including the United States. In the mid-1990s, the Bank faced management problems and difficulties arising from non-performing loans, but reforms launched in 1995 by a new Bank president, Omar Kabbaj, brought new pledges of support from the non-regionals. U.S. contributions to the Bank resumed in FY2000. This report will be updated as events warrant.
Russia's Paris Club Debt: U.S. Interests
Russia is seeking substantial debt forgiveness from its Paris Club debt of some $42 billion. Germany holds about half this official debt; the United States share is 6%. The United States may adopt a policy of no debt relief, of rescheduling payments of principal and interest, or of debt forgiveness. The official position of creditor countries in the Paris Club is for no debt forgiveness. Many in Congress support linkage of any debt relief to an end of the Chechnya conflict and of aid to Serbia, and other foreign and security issues. H.R. 4118, "Russian-American Trust and Cooperation Act of 2000," dealing with a Russian intelligence facility in Cuba, was reported out of the U.S. House of Representatives to be debated starting Wednesday, July 19, 2000. Paris Club negotiations will be discussed at the Okinawa G-8 meeting, July 21-22, 2000. This report will not be updated.
Multilateral Development Banks: Basic Background
As a group, the multilateral development banks (MDBs) are the largest source of development assistance to middle- and low-income developing countries. This report discusses the organization and operations of the MDBs. It shows the share of their lending by region and by economic sector. The report is based on preliminary data for 2000. (The fiscal years for the regional banks ended on December 31.) It uses data for 1999 (to mid-2000 for the World Bank) in several sections. It will be updated when newer data become available.
Asia Pacific Economic Cooperation (APEC) and the 2000 Summit in Brunei
On November 15-16, 2000, the Eighth Asia Pacific Economic Cooperation (APEC) Leaders' Meeting (summit) was held in Bandar Seri Begawan, Brunei. In addition to the APEC summit, President Clinton held bilateral summits with several leaders of APEC countries ­ including China, Russia, Japan, and South Korea. For the United States, APEC raises fundamental questions of special interest to Congress. One is whether consensus can be achieved on the APEC vision of free trade and investment in the Asia Pacific or whether future trade liberalization will be confined primarily to bilateral free-trade agreements or multilateral trade negotiations under the World Trade Organization. Others are whether provision of fast-track negotiating authority to the President should cover negotiations under APEC and whether APEC should be expanded to address political as well as economic issues.
