The International Whaling Convention (IWC) and Legal Issues Related to Aboriginal Rights

Description: This report discusses the recent legislation regarding whaling in general, and aboriginal whaling in particular. Legislative measures, primarily in the form of concurrent resolutions, have been proposed in four categories: protesting commercial, scientific, or community (nonaboriginal) whaling; ensuring aboriginal whaling rights; providing a tax break for aboriginal whaling captains; and addressing the United States' policy at the annual meetings of the IWC.

The Lacey Act: Protecting the Environment by Restricting Trade

Description: This report looks at the history and applications of the Lacey Act. As it stands now the Act, via a 2008 amendment, allows the U.S. to enforce the laws of other countries as well. One currently proposed legislation would limit application of the law to specific wood products, while another would eliminate any reference to violations of foreign laws and end criminal prosecutions for violating the act.

Description: This report discusses laws related to the protection of marine mammals when using mid-frequency active sonar including the Marine Mammal Protection Act (MMPA), the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Coastal Zone Management Act (CZMA). The report discusses each of the laws generally, and then reviews the litigation surrounding the Navy's compliance with these laws in the context of using the sonar for training purposes off California's coast.

The Wild and Scenic Rivers Act and Federal Water Rights

Description: This report discusses federal authority over water, and federal "reserved" and non-reserved water rights. Based on the language of the act and its legislative history, it appears that the act creates federal water rights. The act does not specify the quantity of the right. The amount of the federal right is likely to vary from river to river depending on the river's flows, the unappropriated flows in the river at the time of designation, and the values for which the river is being protected.
