Extraterritorial Application of American Criminal Law
Crime is ordinarily proscribed, tried and punished according to the laws on the place where it occurs. American criminal law applies beyond the geographical confines of the United States, however, under some limited circumstances. The federal exceptions to the general rule usually involve crimes like drug trafficking, terrorism, or crimes committed aboard a ship or airplane. State prosecution for overseas misconduct is limited almost exclusively to multijurisdictional crimes, i.e., crimes where some elements of the offense are committed within the state and others are committed abroad. The Constitution, Congress, and state law define the circumstances under which American criminal law may be used against crimes occurring, in whole or in part, outside the United States
Congress and U.S. Policy on North Korean Human Rights and Refugees: Recent Legislation and Implementation
The passage of the reauthorization of the North Korean Human Rights Act in October 2008 reasserted congressional interest in influencing the Bush Administration's policy toward North Korea. In addition to reauthorizing funding at original levels, the bill expresses congressional criticism of the implementation of the original 2004 law and adjusts some of the provisions relating to the Special Envoy on Human Rights in North Korea and the U.S. resettlement of North Korean refugees. Some outside analysts have pointed to the challenges of highlighting North Korea's human rights violations in the midst of the ongoing nuclear negotiations, as well as the difficulty in effectively reaching North Korean refugees as outlined in the law. Further, the law may complicate coordination on North Korea with China and South Korea.
Nuclear Cooperation with Other Countries: A Primer
In order for the United States to engage in civilian nuclear cooperation with other states, it must conclude a framework agreement that meets specific requirements under section 123 of the Atomic Energy Act (AEA). The AEA also provides for exemptions to these requirements, export control licensing procedures, and criteria for terminating cooperation. Congressional review is required for section 123 agreements; the AEA establishes special "fast track" parliamentary procedures by which Congress may act on a proposed agreement.
Global Climate Change: Status of Negotiations
In December 2007, the parties to the United Nations Framework Convention on Climate Change (UNFCCC) held their 13th annual meeting in Bali, Indonesia, and began the process of working toward an agreement/treaty that would succeed the Kyoto Protocol to the UNFCCC when it expires in 2012. The Protocol includes a mandate for a reduction of greenhouse gas (GHG) emissions by 30 developed/industrialized nations to an average of some 5% below their 1990 levels over the commitment period 2008-2012. The broad array of these issues, briefly discussed in this report, has been described by some as comprising perhaps the most complex negotiations ever undertaken internationally.

The NATO Summit at Bucharest, 2008
NATO held a summit in Bucharest, Romania, April 2-4, 2008. The summit did not become the occasion to adopt major new ideas or initiatives. A "Strategic Vision" paper on Afghanistan clarified several issues but did not lead to a greater sharing of the combat burden among NATO governments. Croatia and Albania, but not Macedonia, were invited to begin accession negotiations for membership. In a contentious debate, neither Georgia nor Ukraine were admitted to the MAP process. Instability in Chad
This report discusses the currently volatile political and security situation in Chad. Some issues Chad is currently facing include ethnic clashes, banditry, and fighting between government forces and rebel groups; a large number of displaced persons who have fled Chad to the neighboring nation of Cameroon; an increasing number of refugee influx from the nearby troubled regions of the Central African Republic (CAR) and Sudan's Darfur; and inadequate security forces.
China's Space Program: Options for U.S.-China Cooperation
China has a determined, yet still modest, program of civilian space activities planned for the next decade. The potential for U.S.-China cooperation in space -- an issue of interest to Congress -- has become more controversial since the January 2007 Chinese anti-satellite test. Some argue that Chinese capabilities now threaten U.S. space assets in low earth orbit. Others stress the need to expand dialogue with China. It is seeking to integrate into the European Union (EU), but its progress has been hindered by a failure to arrest four remaining indicted war criminals and by tensions with the United States and the EU over the independence of Serbia's Kosovo province. The United States, Britain, France, Germany, Italy, and most other EU countries have recognized Kosovo's independence. Serbian leaders condemned said recognition and have withdrawn Serbia's ambassadors from the United States and other countries recognizing Kosovo's independence. The second session of the 110th Congress may consider legislation on Serbia, including conditions on aid to Serbia.

Persistent Organic Pollutants (POPs): Fact Sheet on Three International Agreements
Persistent organic pollutants (POPs) are chemicals that do not break down easily in the environment, tend to accumulate as they move up the food chain, and may be harmful to people and wildlife. Between 1998 and 2001, the United States signed tow international treaties and one executive agreement to reduce the production and use of POPs and to regulate the trade and disposal of them. This report discusses these treaties in detail, as well as their ratification process and U.S. statutes that are inconsistent with these treaties.

The European Parliament
The 785-member, directly elected European Parliament (EP) is a key institution of the 27-member European Union (EU). Once limited to being a consultative assembly, the EP has accumulated more power over time. Currently, it plays a role in the EU's legislative and budgeting processes, and exercises general supervision over other EU bodies. Ties between the EP and the U.S. Congress are long-standing, and EPCongressional exchanges are expected to continue in the second session of the 110th Congress.
The European Union's Reform Process: The Lisbon Treaty
In December 2007, leaders of the European Union (EU) signed the Lisbon Treaty, which seeks to reform the EU's governing institutions and decisionmaking processes to enable a larger EU to operate more effectively. This new treaty represents the latest stage in a reform process begun in 2002 and essentially replaces the proposed EU "constitution" that foundered after French and Dutch voters rejected it in referendums in 2005. In June 2008, Irish voters rejected the Lisbon Treaty, and have thrown its future into doubt. For years, the British and Irish governments sought to facilitate a peaceful settlement to the conflict in Northern Ireland. After many ups and downs, the two governments and the Northern Ireland political parties participating in the peace talks announced an agreement on April 10, 1998. Despite a much improved security situation in the years since then, full implementation of the resulting Good Friday Agreement has been difficult. On May 8, 2007, however, Northern Ireland's devolved political institutions were restored after an almost five-year suspension following a powersharing deal between the largest unionist and nationalist parties.

The Iran Sanctions Act (ISA)
No firms have been sanctioned under the Iran Sanctions Act (ISA), and a GAO study in December 2007 said that the effects of ISA and other U.S. sanctions on Iran's economy are "difficult to determine." However, with Iran under increasing U.N. and other diplomatic pressure, many foreign firms now seem hesitant to finalize investment deals with Iran. In the 110th Congress, several bills, including the House-passed H.R. 1400 would add ISA provisions.
U.S.-Latin America Trade: Recent Trends
After Congress passed Trade Promotion Authority (TPA) legislation in August 2002 (P.L. 107-210), the United States implemented free trade agreements (FTAs) with Chile, the Dominican Republic, the Central American countries, and Peru. The United States has also concluded FTAs with Colombia and Panama, which await congressional action.1 Talks on the region-wide Free Trade Area of the Americas (FTAA), by contrast, have stalled. The 110th Congress may consider implementing legislation for one or both of the pending bilateral agreements. The Overseas Private Investment Corporation: Background and Legislative Issues
The Overseas Private Investment Corporation (OPIC)1 was established in 1969 and began operations in 1971 to promote and assist U.S. business investment in developing nations. OPIC is a U.S. government agency that provides project financing, investment insurance, and other services for U.S. businesses in 154 developing nations and emerging economies. OPIC is currently authorized through March 9, 2009 under the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (P.L. 110-329).
Improvised Explosive Devices (IEDs) in Iraq and Afghanistan: Effects and Countermeasures
Since October 2001, Improvised Explosive Devices (IEDs, or roadside bombs) have been responsible for many of the more than 2,000 combat deaths in Iraq, and 178 combat deaths in Afghanistan. IEDs are hidden behind signs and guardrails, under roadside debris, or inside animal carcasses, and encounters with these bombs are becoming more numerous and deadly in both Iraq and Afghanistan. Department of Defense (DOD) efforts to counter IEDs have proven only marginally effective, and U.S. forces continue to be exposed to the threat at military checkpoints, or whenever on patrol. IEDs are increasingly being used in Afghanistan, and DOD reportedly is concerned that they might eventually be more widely used by other insurgents and terrorists worldwide.
Balkan Cooperation on War Crimes Issues
In early May 2006, assessments of insufficient Serbian cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) led the European Union (EU) to suspend association talks with Serbia. Later that month, the U.S. Secretary of State withheld certification of full Serbian cooperation with ICTY, leading to a partial suspension of U.S. bilateral assistance to Serbia. From late 2004 through early 2005, a combination of intensified international pressure and deadlines associated with Euro-Atlantic integration processes prompted a spate of transfers of indicted persons to the tribunal. Full cooperation with ICTY is a key prerequisite to further progress toward a shared long-term goal for the western Balkan countries: closer association with and eventual membership in the European Union and NATO.

British and Irish leaders have set a November 24, 2006, deadline to revive talks on governance in Northern Ireland.
