The Energy Independence and Security Act of 2007 (EISA, P.L. 110-140), significantly expanded the renewable fuel standard (RFS) established in the Energy Policy Act of 2005 (EPAct 2005, P.L. 109-58). The RFS requires the use of 9.0 billion gallons of renewable fuel in 2008, increasing to 36 billion gallons in 2022.

Coast Guard Polar Icebreaker Modernization: Background and Issues for Congress
The Coast Guard's proposed FY2013 budget includes $8 million in acquisition funding to initiate survey and design activities for a new polar icebreaker. The Coast Guard's Five Year Capital Investment Plan includes an additional $852 million in FY2014-FY2017 for acquiring the ship. The Coast Guard anticipates awarding a construction contract for the ship "within the next five years" and taking delivery on the ship "within a decade." The project to design and build a polar icebreaker is a new acquisition project initiated in the FY2013 budget.

In the Summer of 2005, Congress focused on several Clean Air Act Issues before the August recess. Although the Congressional agenda stated that attention would be given to the needed amendments of the Clear Skies/Multi-Pollutant Legislation, this progress was stalled, and the committee failed to approve the bill due to a tied vote. This otherwise stagnated debate was given some attention due to the discussions over mercury regulations as they apply to power plants. The outcome of the decision concerning these regulations has stirred controversy in at least fifteen states. Perhaps the most debated issue that Congress covered concerned MTBE and Ethanol, which have been used to meet the Clean Air Act requirements that reformulated gasoline (RFG), sold in the nation’s worst ozone nonattainment areas, contain at least 2% oxygen, to improve combustion. Air quality standard deadlines and provisions, specifically in the most severe ozone nonattainment areas, were discussed by Congress. Discussions over the Clean Air Act also sparked discussions over environmental regulations concerning related issues, including the Conformity of Transportation Plans and SIPs, and Hurricane Katrina.

Clean Water Act Section 401: Background and Issues
Section 401 of the Clean Water Act requires that an applicant for a federal license or permit provide a certification that any discharges from the facility will comply with the Act, including water quality standard requirements. Disputes have arisen over the states' exercise of authority under Section 401. Until recently, much of the debate over the Section 401 certification issue has been between states and hydropower interests. A 1994 Supreme Court decision which upheld the states' authority in this area dismayed development and hydroelectric power interest groups. The Court revisited these issues in a 2006 ruling that unanimously upheld the states' authority to condition hydropower licenses. The dispute between states and industry groups about Section 401 authority has been a legislative issue on several occasions, but Congress has not responded by modifying the provision's scope. In addition, there has been interest in clarifying whether Section 401 certification applies to nonpoint source discharges, such as rainfall runoff, as well as point source discharges from pipes or ditches.

A U.S.-centric Chronology of the International Climate Change Negotiations
This document provides a U.S.-centric chronology of the international policy negotiations to address climate change. It covers the United Nations Framework Convention on Climate Change in 1992, the Kyoto Protocol in 1997, the Marrakesh Accords of 2001, and the Bali Action Plan of 2007 that mandates the current negotiations toward a new agreement by the end of 2009 on commitments for the period beyond 2012. Today's negotiations under the Bali Action Plan focus on four elements: mitigation of greenhouse gas emissions; adaptation to impacts of climate change; financial assistance to low income countries; and technology development and transfer. For U.S. legislators, important issues include the compatibility of any international agreement with U.S. domestic policies and laws; the adequacy of appropriations, fiscal measures and programs to achieve any commitments under the agreement; and the desirable form of the agreement and related requirements for potential Senate ratification and federal implementing legislation.

The Copenhagen conference in December 2009 achieved only mandates to continue negotiating toward the next Conference of the Parties (COP) to be held in Mexico City in December 2010. As a background to these proceedings, this document provides a U.S.-centric chronology of the international policy deliberations to address climate change from 1979-2009. Negotiations underway since 2007 have run on two tracks, the Kyoto Protocol the Convention under the Bali Action Plan. Many in the U.S. Congress are concerned with the goals and obligations that a treaty or other form of agreement might embody. For U.S. legislators, additional issues include the compatibility of any international agreement with U.S. domestic policies and laws; the adequacy of appropriations, fiscal measures, and programs to achieve any commitments under the agreement; and the desirable form of the agreement and related requirements, with a view toward potential Senate ratification of the agreement and federal legislation to assure that U.S. commitments are met.

Coast Guard polar icebreakers perform a variety of missions supporting U.S. interests in polar regions. The Coast Guard's two heavy polar icebreakers - Polar Star and Polar Sea - have exceeded their intended 30-year service lives. Following a decision to design and build one or more new polar icebreakers, the first replacement polar icebreaker might enter service in eight to 10 years, by which time Polar Star and Polar Sea could be more than 40 years old. The issue for Congress is whether to approve, reject, or modify Coast Guard plans for modernizing its polar icebreakers. Congressional decisions on this issue could affect the Coast Guard's ability to perform its polar missions, Coast Guard funding requirements, and the U.S. shipbuilding industrial base.

International Climate Change: A Negotiations Side-by-Side
This report discusses various cooperative international efforts to address the issue of global climate change. The two major international agreements discussed in a side-by-side comparison are the 1997 Kyoto Protocol and the 2010 Copenhagen Accord. The Deepwater Horizon Oil Spill: Coastal Wetland and Wildlife Impacts and Response
The explosion of the Deepwater Horizon drilling rig in the Gulf of Mexico on April 20, 2010, and the resulting oil spill began a cascade of effects on the coastal areas of the Gulf and on the wealth of species that inhabit those areas. This report addresses the importance of wetlands in general, the ecology of the coastal wetlands in the Gulf, impacts of oil spills on wetland habitats, response options, the implications of hurricane season for the spill's impacts, and cleanup and recovery issues. The emphasis is on the nearshore environment, although a few species found in deeper waters will be mentioned. In addition, some lessons from past spills such as the Exxon Valdez in Alaska will be discussed, along with issues that may arise as response and recovery transition to restoration of the Gulf.
Marine Protected Areas: An Overview
Marine protected areas (MPAs) are generally defined as areas reserved by law or other effective means to protect part or all of the enclosed environment. This report identifies a number of issues related to establishing MPAs in the United States. It begins by defining the concept and administrative actions taken to provide spatial protection in marine areas. It then considers some of the key issues and potential benefits and costs of designating additional MPAs. It concludes by considering potential areas of congressional interest for the 111th Congress. Existing federal laws related to the use of MPAs are summarized in the Appendix.
Water Infrastructure Projects Designated in EPA Appropriations: Trends and Policy Implications
This report discusses appropriations for Environmental Protection Agency (EPA) water infrastructure programs, focusing on congressional special project designations in the account that funds these programs. While some Members of Congress, interest groups, and Administration officials are critical of these types of congressional actions, there is little indication that the practice will cease. Information on the programmatic history of EPA involvement in assisting wastewater treatment and drinking water projects also is provided in two appendixes.
Pesticide Use and Water Quality: Are the Laws Complementary or in Conflict?
This report provides background on the conflict over interpretation and implementation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Clean Water Act. A brief discussion of the two laws is followed by a review of the major litigation of interest. EPA's efforts to clarify its policy in this area and the November 2006 rule and the 2009 federal court ruling are discussed, as well as possible options for EPA and Congress to further address the FIFRA-CWA issues. In June, EPA proposed a draft general CWA permit that it intends to finalize by April 2011 in response to the court ruling.
Carbon Capture and Sequestration (CCS)
Carbon capture and sequestration (or storage) - known as CCS - has attracted interest as a measure for mitigating global climate change because large amounts of carbon dioxide (CO2) emitted from fossil fuel use in the United States are potentially available to be captured and stored underground or prevented from reaching the atmosphere. Congressional interest has grown in CCS as part of legislative strategies to address climate change. The large and rapid influx of funding for industrial-scale CCS projects may accelerate development and deployment of CO2 capture technologies.
Climate Change: The Role of the U.S. Agriculture Sector and Congressional Action
The debate in Congress over whether and how to address possible future climate change is intensifying. Often, the role of the U.S. agriculture sector is invoked in this debate. Agriculture is a source of greenhouse gas (GHG) emissions, which many scientists agree are contributing to observed climate change. Congress is considering a range of climate change policy options, including GHG emission reduction programs that would either mandate or authorize a cap-and-trade program to reduce GHG emissions. This report discusses this issue in detail, i.e., how the agricultural industry affects GHG emissions and efforts currently underway to combat these negative effects, but it does not address the potential effects of global climate change on U.S. agricultural production.

The Security and Prosperity Partnership of North America (SPP) is a trilateral initiative that was launched in March 2005 for the purpose of increasing and enhancing security and prosperity in the United States, Canada, and Mexico. Estimates of Carbon Mitigation Potential from Agricultural and Forestry Activities
Numerous theoretical and empirical studies estimate the greenhouse gas (GHG) mitigation potential of farm and forestry activities, and suggest that the potential for carbon uptake in agricultural soils and forest lands is much greater than current rates. Following a discussion of the estimated current emissions and carbon sequestration by the agricultural and forestry sectors, this report presents a brief overview of the available estimates from USDA and EPA carbon mitigation studies, and then discusses some of the limitations of the available data and modeling results. This report is organized into four parts, including a brief overview of the agriculture and forestry sectors within the broader climate change debate, as well as various data and information on potential for carbon storage and mitigation from farming and forestry activities.
Global Climate Change: Three Policy Perspectives
The 1992 U.N. Framework Convention on Climate Change requires that signatories, including the United States, establish policies for constraining future emission levels of greenhouse gases, including carbon dioxide (CO2). The George H. W. Bush, Clinton, and George W. Bush Administrations each drafted action plans in response to requirements of the convention. These plans have raised significant controversy and debate. This report examines three starting points from which a U.S. response to the convention is being framed.
The Endangered Species Act and Private Property
If the 103rd Congress embarks upon an effort to reauthorize the Endangered Species Act (ESA), it will run into an old acquaintance: the property rights issue. As now written, the ESA has at least the potential to curtail property rights (whatever its actual impact as implemented may be). Market-Based Environmental Management: Issues in Implementation
Increasingly, efforts to protect integral features of the natural environment that are essential to human well being face a double challenge. First, the magnitude of some conventional and emerging threats to environmental quality is growing, despite solid progress in controlling some causes. This is particularly the concern on a global scale in terms of atmospheric changes and loss of biological diversity. Second, easily-implemented uniform control methods using feasible technologies or other direct regulatory approaches are already in place for many pollution and resource management problems in the United States. Additional progress with so-called command and control policies can be expensive and disruptive, and thus counter productive to overall economic well being. This type of dilemma is common where environmental deterioration results from diffuse and complex causes inherent in technically-advanced high-consumption industrial societies such as the U.S. Solutions to these types of environmental problems are complicated by the diffuse benefits which obscures the net gains of additional controls that have concentrated and highly visible costs. Given this double bind, many policy analysts and academics have for years advocated more cost-effective and flexible approaches relying on market forces to further some environmental management objectives. Although market-based theory and practical environmental policy are still far apart, the incremental approach to environmental policymaking since the late seventies has resulted in some market-type innovations within traditional regulatory frameworks at all levels of government. The most prominent examples are the Environmental Protection Agency's (EPA) air emissions trading program and the recently enacted sulfur dioxide allowance trading program under the 1990 Clean Air Act Amendments.
The World Bank's Clean Technology Fund (CTF)
The United States Treasury has led efforts to create a $10 billion Clean Technology Fund (CTF), located at the World Bank, to help fund deployment of clean technology to reduce greenhouse gas emissions in developing economies. The Bush administration has asked Congress to authorize and appropriate U.S. funding of $2 billion over three years (FY2009 to FY2011). While many Members of Congress have expressed support for the CTF, others have raised concerns, primarily with respect to whether the CTF should finance carbon-based energy projects. To date, Congress has not passed legislation authorizing or appropriating U.S. contributions to the Fund.
Natural Gas Passenger Vehicles: Availability, Cost, and Performance
Higher gasoline prices and concerns over U.S. oil dependence have raised interest in natural gas vehicles (NGVs). Use of NGVs for personal transportation has focused on compressed natural gas (CNG) as an alternative to gasoline. Consumer interest has grown, both for new NGVs as well as for conversions of existing personal vehicles to run on CNG. This report finds that the market for natural gas vehicles will likely remain limited unless the differential between natural gas and gasoline prices remains high in order to offset the higher purchase price for an NGV. Conversions of existing vehicles will also continue to be restricted unless the Clean Air Act (CAA) is amended or if the Environmental Protection Agency (EPA) makes changes to its enforcement of the CAA.

The federal role in assisting states and communities to clean up brownfield sites -- real property affected by the potential presence of environmental contamination -- has been an ongoing issue for more than a decade. While there appears to be a broad consensus that a federal role in the cleanup and redevelopment of brownfields is desirable, issues regarding the degree of financial assistance and overall program effectiveness have been raised.
