The Federal Role in Rail Transit Safety
On June 22, 2009, two transit trains in Washington, DC, collided, resulting in nine deaths and dozens of injuries. It was the worst crash in the history of the Washington Metropolitan Area Transit Authority's rail transit system. This crash has raised questions about the safety of rail transit and the government's role in ensuring that safety. Nationwide, rail transit is considered one of the safest modes of transportation. This report discusses the State Safety Oversight Program, which went into effect in 1997 and mandates that states are responsible for the safety of the rail transit systems within their borders. F-35 Alternate Engine Program: Background and Issues for Congress
This report discusses the past four years of administration proposals to terminate the program to develop the General Electric/Rolls-Royce F136 engine as an alternative to the Pratt & Whitney F135 engine that currently powers the F-35 Joint Strike Fighter (JSF). Aviation Security-Related Findings and Recommendations of the 9/11 Commission
In response to the 9/11 Commission’s aviation security-related recommendations, two bills — H.R. 5121 and H.R. 10 — introduced in the House contain several provisions to enhance aviation security. Additionally, floor amendments to S. 2845, the National Intelligence Reform Act of 2004, contain numerous aviation security provisions, many of which address 9/11 Commission recommendations related to aviation safety. S. 2845 was passed (96-2) by the Senate on October 6, 2004. The House passed H.R. 10 on October 8 by a vote of 282-134. Aviation Security-Related Findings and Recommendations of the 9/11 Commission
The 9/11 Commission issued several recommendations designed to strengthen aviation security by: enhancing passenger pre-screening; improving measures to detect explosives on passengers; addressing human factors issues at screening checkpoints; expediting deployment of in-line baggage screening systems; intensifying efforts to identify, track, and screen potentially dangerous cargo; and deploying hardened cargo containers on passenger aircraft. Proposed Keystone XL Pipeline: Legal Issues
This report reviews those legal issues. First, it suggests that legislation related to cross-border facility permitting is unlikely to raise significant constitutional questions, despite the fact that such permits have traditionally been handled by the executive branch alone pursuant to its constitutional "foreign affairs" authority. Next, it observes generally that state oversight of pipeline siting decisions does not appear to violate existing federal law or the Constitution.
