Electricity Restructuring: Comparison of Comprehensive Bills
Once considered the nation's most regulated industry, the electric utility industry is evolving into a more competitive environment. Currently, the focus of this development is the generating sector, where the advent of new generating technologies has lowered both entry barriers to competitors of traditional utilities and the marginal costs of those competitors below those of some traditional utilities. Electricity Restructuring and the Constitutionality of Retail Reciprocity Requirements
Retail reciprocity requirements have been included in the electricity restructuring legislation of at least four states. These requirements mandate generally that out-of-state utilities which operate in a state “closed” to retail competition cannot market power to retail consumers in the “open” state. Because state reciprocity requirements enacted without congressional authorization are probably unconstitutional under the Commerce Clause of the U.S. Constitution, Congress would have to include a reciprocity provision in federal electricity restructuring legislation if it wants to support the view that such a provision will increase competition. Nuclear Power Plants: Vulnerability to Terrorist Attack
Protection of nuclear power plants from land-based assaults, deliberate aircraft crashes, and other terrorist acts has been a heightened national priority since the attacks of September 11, 2001. The Nuclear Regulatory Commission (NRC) has strengthened its regulations on nuclear reactor security, but critics contend that implementation by the industry has been too slow and that further measures are needed. Several provisions to increase nuclear reactor security are included in the Energy Policy Act of 2005, signed August 8, 2005. The law requires NRC to conduct "force-on-force" security exercises at nuclear power plants at least once every three years and to revise the "design-basis threat" that nuclear plant security forces must be able to meet among other measures. digital.library.unt.edu/ark:/67531/metacrs10267/

Department of Energy: Programs and Reorganization Proposals
This report, a revision of an earlier CRS review of DOE programs, consists of an introductory discussion of the agency and its mission as a whole, and a description of its major programs as independent entities. Many of DOE's original energy-related missions have disappeared or changed radically. In addition, with the end of the Cold War, DOE's nuclear weapons-related programs, almost two-thirds of the total budget, are undergoing modification.
