Agricultural Issues in the 109th Congress

Description: A number of issues affecting U.S. agriculture are receiving attention during the 109th Congress. Some are related to new initiatives or to unfinished legislation from the 108th Congress; others have been the focus of ongoing congressional oversight. Although the current (2002) farm bill (P.L. 107-171) generally does not expire until 2007, the agriculture committees could begin hearings on a new measure later this year. Meanwhile, the agriculture committees are required by the adopted FY2006 bud… more

Agriculture and Fast Track or Trade Promotion Authority

Description: New “fast track” (or, trade promotion) authority (TPA) is at issue in the 107th Congress. Such authority could enable the Administration to submit negotiated foreign trade agreements to Congress for consideration under expedited procedures. Efforts to renew this authority, which expired in 1994, have not succeeded since then. Many agricultural and food industry interests are among the export-oriented enterprises that support TPA, arguing that foreign trading partners will not seriously negotiat… more

Changing Senate Rules: The "Constitutional" or "Nuclear" Option

Description: This report indicates possible attempts to curtail the use of filibusters in the Senate, perhaps in the 109th Congress. Some have suggested that proponents of this idea may invoke something called the “nuclear” or “constitutional” option in Senate floor procedure to try to end a filibuster without the need for 60 votes or to amend the cloture rule (Rule XXII) itself. This report presents several possible scenarios that would require one or more of the Senate’s precedents be overturned or interp… more

Clean Air Act Issues in the 109th Congress

Description: The courts and the executive branch face major decisions on clean air issues in 2006, with Congress more likely playing an oversight role. One focus is EPA's Jan. 17 2006 proposal to strengthen air quality standards for fine particles, which are estimated to cause tens of thousands of premature deaths annually. Whether the proposal is supported by the available science and what impact its implementation would have likely issues of concern. Other issues of continuing interest are EPA's 2005 deci… more

Committee Funding for the House and Senate, 108th Congress

Description: The Senate adopted ad hoc procedures in approving committee operating budgets. With the Senate divided 51-48-1 at the beginning of the 108th Congress, Senate Democrats argued for a proportional allocation of committee staff between the parties. On January 15, after a week-long delay in the appointment of Senate committees, a unanimous consent agreement was reached providing for the proportional allocation of staff and office space between the parties on each committee, with a separate provision… more

Congressional Access to Executive Branch Information: Legislative Tools

Description: This report begins by reviewing the precedents established during the Washington Administration for withholding documents from Congress. Close examination reveals that the scope of presidential privilege is often exaggerated. Congress had access to more documentation than is commonly believed and might have had more had it pressed for it. Subsequent sections focus on various forms of congressional leverage: the power of the purse, the power to impeach, issuing congressional subpoenas, holding e… more
