This report discusses the rights of service-members to refuse service abroad if the foreign service was in an undeclared war. The lawsuit of the State of Massachusetts which was brought against the federal government after the passage of a law in Massachusetts giving service-members this right is discussed as well as various other judicial decisions made in lower courts regarding the issue.
